please help! my visa was taken away because of overstay! :(

You said you bought an apartment in Boston. Visitor visas are not for the intent to stay and sorry to say but if you bought a place to live it looks like you had no intention of ever returning home. Just because family is here does not mean automatic approval for you to stay. I am sorry to hear of the struggle, but I am not surprised. You can try the things suggested so far, but also know there is a good probability you may need to wait a good while.

Why get a lawyer for a visitor visa. He violated the overstay (the law says the date to leave) there are no days for extension. Also, he has already established that he plans to reside in the US. (

I arrived in the summer to help my brother with his nasty divorce and also to see that the new biz is set up right for him. I ended up staying till January 11, and I was not aware I was supposed to leave the USA on the 9th (2 days overstay). when I arrived last Sunday, they cancelled my visa right away and I was sent back shamefully, while other people in the room with much worse visa problems were free to go. I was treated like a criminal JUST BC OF THOSE 2 days! it really upset me because I just bought an apartment in Boston and my parents are so well invested in the USA and my brother is a citizen-it's no way to treat me.

dude, you overstayed.. your fault.. that is exactly how you should be treated.. what did you expect? sympathy? and good job on stating you went ahead and bought yourself an apartment.. another good reason for you to have been sent home.. clearly you have every intention to stay here illegally.. your brother being a citizen does not give you any special privileges..

Sounds like he was here 6 months and 3 days, then left for a few months and then sought to enter on an invalid visa.

As far as another visa is concerned, well you apply and see.

Anyone can buy property in the US. Doing so makes it harder to prove you don't intend to overstay. All the old folks in Florida during the winter aren't just from NY and Mass. Many Canadians and EU residents spend part of the winter in warmer weather.

This will not be over quickly. You will not enjoy this.

Writing the Prez is a waste of time they don't responds to those emails

why not try to get an investors visa by way of having an atty take this case

to the correct dept. since there are obviously investments , also in all honesty

Israelis do get better breaks in the immigration dept. good luck

there are topics you would be better off not posting at this forum. The members here are much more cruel than CBP or any other government agency.

Cruel? Maybe it is hard to hear the truth, but that is what I see people offering here... honest answers. Are they all put delicately? No, but I do not think any of them are "cruel" either.

The way the OP came in with the attitude of " my parents are so well invested in the USA and my brother is a citizen-it's no way to treat me" for something he did wrong, especially saying he bought an apartment when he does not have a valid visa to live here, much less a valid visa at all kind of begs for the answers of you need to understand the way the system works, and get help because the way you handled it is not in your favor.
