Trying to get some help kind of getting frustrated, Filled out I-130's for my Wife and 2 Daughters, they are in Central America, Got NOA2 on 04/17/2013, been calling the NVC for the last 2 weeks, and sent the email to nvcresearch on day 15th as advised by the NVC rep 4 days ago.

Today I called USCIS and they transferred to an Immigration officer, after 1 Hour and 36 Minutes on HOLD a super rude agent picked up, he asked for my address, name and DOB and said my files were still with the officer in charge of the case, haven't even left USCIS. I told him what was the delay that the note I received almost a month ago clearly said "Petition approved and forwarded to the NVC" all he said was that it can take up to 4 months to leave USCIS even if i receive that letter and that all i could do was wait and almost hung up on me.

It's ridiculous that a petition approved a month ago is still sitting on a desk and all they have to say is wait and that there is nothing they can do.

How can I proceed anything I can do? Please advise

I would pop on over to the NVC filers thread and ask. many there gave waited longer. I have two friends who waited 86 days and 92 days to arrive at NVC, They are still waiting for case#'s 2 weeks later. here;s the link.

What you were told is the truth in at least some cases. Mine for example suffered exactly this and in the end took 408 days.

A good question to ask is if USCIS gave the file a bar code. That is the last step before forwarding in bundles in a seemingly random fashion.

Those bundles can sit at NVC for a unknown time until they are scanned into the NVC system. Until then they are in a sort of limbo.

One method to locate the case would be to make an Info Pass appointment where you can sit down with USCIS. You will be told they show the case in route to NVC. This could all result in USCIS taking action to locate the case. You will at least know someone is trying.

since you have a MSC Receipt #, it's quite possible the casefile was sent on to a local office and adjudicated there.

Local offices have there own local guidelines for casefile movement, some offices batch monthly, some offices wait till there's a pile, some offices send out weekly.

For now - I think it's useful to chase down the local office city, then set up an infopass appointment with the local office, get in, and talk with a human there.

how to find out the local office:

1. call into USCIS, get an ISO.

2. ask the ISO:

--a. what date was the casefile transferred to the local office?

--b. what's the city for the local office ?

3. get to http://infopass.uscis.gov and set up an infopass appointment

4. once at the infopass appointment - ask for the floor supervisor.

5. ask the floor supervisor to contact the I-130 adjudication unit supervisor and inquire about the casefile

--a. ask if the a-file has been created

--b. ask if the scanning is done yet

--c. ask what the schedule for casefile sending is, the general schedule

--d. ask when your casefile will leave the building

That's about all you can do, at the moment. Sure, you could initiate a Congressional Inquiry - sometimes that helps a lot.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

I initiated the congressional inquiry yesterday via email, called and asked who handled the immigration issues and got his email. He got back to me with a privacy form I needed to fill out, attached a short but detailed letter. Hope to hear something soon
