Hey guys, I just realized while getting my paperwork ready for AOS, that my I-94 expiration date is different from my K1 Visa. The officer stamped my i-94 for only 3 months, I entered USA on february 13, and he stamped it May 13, so apparently it is expired but not my visa. This looks weird for me because when I used my tourist visa they always stamped my i-94 for 6 months.

Will I have problems when filling for AOS??? Please help. How did your i-94 vs visa look like???

That is totally normal. The expiration date on the K1 is the last day you can use it to enter the country, it is useless once you have entered the US. As long as you marry before your I94 expires (90 days), you will have no trouble filing for AOS but most recommend filing before 90 days as well.

Your visa expired the minute you used it. It's simple, the visa expiration date is the date until you had to use that visa to enter the US. Once used, the officer stapled your passport with the I-94, which expires 90 days after your entry. It means you had 90 days after your entry to get married to your K-1 petitioner. The visa expiration date is now irrelevant.

Once those 90 days are up (I-94 expired), you will be out of status. It's not a very bad thing but you are encouraged to file to adjust your status as soon as possible. Those out of status (or illegal) days will be forbidden once you file for AOS.

It is the same thing for your tourist visa. It is valid for 10 years but each time you use it, you can only stay for 6 months. Except that your tourist visa was a multiple-entry visa, while the K-1 is single-entry.

- Aug 31st, 2011 - Mailed I-129F package - May 29th, 2012 - Mailed AOS/EAD/AP package

- Apr 13th, 2012 - Visa received - Aug 24th, 2012 - Green Card received

- May 19th, 2014 - Mailed ROC package to CSC

- Aug 8th, 2014 - Green Card received

N-400 Timeline

- Dec 29th, 2021 - Filed online. Got notice that biometrics will be reused.

ya, the K-1 visa is invalidated at the POE, as it's a single use visa.

The expiration date show there is the last date you can enter the USA.

The I-94 governs your lawful presence in the USA.

If you married within 90 days of your POE date, yer set. You can file the AOS set anytime, is no reg or rule or law about WHEN to file the AOS set.

I don't see any marriage date on yer timeline, so if you DID NOT marry within those 90 days, and married AFTER the 90 days, plan on filing an I-130 WITH the AOS set.

thanks for your quick responses. I got married already so I am filling documents for AOS. I dont remember what form it was but they asked for my I-94 and then expiration date? that is why I was confused on why visa and i 94 were different dates, so I guess I will have to write my expired date. It expired May 13th.
