I have a question on having a co-sponsor.



My mom is planning on being the sponsor but she has not filed her taxes for this year yet. She also stated that if she did file them now her tax guy said he wouldnt be able to have any sort of papers back until August or so? I'm not sure exactly how that works.



My question is if there is a way around this.



My mom has her last 2 years of tax returns (not counting this years) and she makes more than enough to be a sponsor for my husband. Like I said the main issue here is she doesnt have this year's tax returns yet- still needs to file.


Has anyone heard about or thinks its possible to go about this a different way. Like to state that we would send in the tax return for this year as soon as possible while sending in the prior 2 years along with maybe a letter from her employer stating she is employed and receiving X amount per year? Or that she received that much last year with pay stubs?

I met my him in Paris -Winter 2011


We emailed/skyped back in forth until he came in Summer 2012 on touristic visa


He stayed from summer 2012 until winter 2012 (4 months)


Winter 2012 I went to visit him and meet his family (2 months)


March 2013 he came back to the US on a touristic visa


We are about to get married.

as long that she will write a letter explaining why she haven't file for her tax yr 2012.

make sure to include a copy of her green card if she's not US citizen yet and if she is her passport will do.

letter from her employer will also help you.

or otherwise, maybe consider looking for full time job if you don't have one. anyways you will need to, to support your family.

She is a US citizen...

Unfortunately Im not sure there's a "real" reason she hasnt filed them yet- simply that she hasnt I think...

Is there anything that she would be able to say? Other than she just filed them ?

I can't look for a full time job at the moment because I'm a full time student :/ also we are planning on submitting the AOS in 3 weeks..

It she still hasn't filed her tax returns, maybe she could include a letter explaining why and include a copy of an extension to file (which I hope she has). Definitely include a letter from the employer confirming active employment and salary information. That's really all you can do for now and follow up with the return when available.

My USCIS Journey...

 

I had an I-485 filing already submitted through an employment-based application. Post-marriage, I submitted an I-130, which after being approved was interfiled with the existing I-485.

Interfiling/AOS Timeline:

01/03/14 - Day 274 - Interfiling request received by USCIS

04/03/14 - Day 364 - Interfiling service request sent

04/30/14 - Day 391 - Second interfiling service request sent

05/19/14 - Day 410 - Email sent asking for case status update

06/04/14 - Day 426 - Response received that I-485 was transferred to NBC

06/05/14 - Day 427 - I-485 updated to "sent to local office for processing"

07/02/14 - Day 454 - Status changed to testing & interview. Interview date August 4!!

08/04/14 - Day 487 - Mini-Stokes interview. IO intended on approving AOS but the computer did not show I-130 approval. The wait goes on...

08/18/14 - Day 501 - Spoke with Tier 2 IO - said that my I-485 is approved but no card prodn ordered. Asked to call back in 2 weeks if no update.

08/29/14 - Day 512 - Spoke with Tier 2 IO - said that my I-485 was not approved yet, but my file was with an IO for a decision

09/03/14 - Day 517 - Wrote a request to my Congressman asking for assistance

09/09/14 - Day 523 - Status updated to Card/Document Production

09/15/14 - Day 529 - Status update - Card mailed to address on record/permanent resident status registered

Unfortunately, none of us can answer that. Hopefully, with a salary and employment confirmation, coupled with the last two years of tax returns, the case reviewers will be a little more lenient. The worst that can happen is an RFE. Your case will not be denied outright.

Just bear in mind that if you do get an RFE, you only have a certain window within which to response. So, you may want to talk to your mom to see if there is any way she can complete the return sooner rather than later. I don't understand why her accountant has said that even if she files now that he will not have the paperwork until back until August. Unless of course he is referring to papers that are needed to complete the return. If this is the case, there is nothing you can do except ask if there is any way that could be expedited. If she is able to file a completed return, she should have all the paperwork she needs to submit to the USCIS.

Whatever you do, certainly include a detailed letter on why the most recent tax return is not included.

I think he was referring to her applying for an extension...

I know there are no definite answers but I'm just looking for an opinion Thank you for responding!

So basically my best bet is to file her last 2 years of tax returns, a letter from her employer stating her employment from last year and continuing this year, and maybe some direct deposit papers showing her being payed?

I'm just worried since she is applying for an extension- what will happen if the RFE us and due to her extension doesnt have her forms back yet? I'm hoping the case reviewers will see that she has an extension and thus wont have them yet?

Sorry for asking questions that may not be able to be answered by users- I'm just hoping someone has experienced this or maybe can help since as a full time college student I'm not fully aware of the tax processes.
