Hello,

Just wondering if anyone knows any possible reasons for being denied the work permit while waiting for the I485 to be approved.

My husband has not been denied yet- but we are just asking for the risk factors.

I am the USC and he is the beneficiary. We wanted to know if there is a large chance that the I765 wouldnt get approved?

Also, would the employers need to know that he is on a temporary work permit (I765)?

We are just wondering because getting the I765 is a necessity.

Just for background in case it makes a difference in the answer...

I met my him in Paris -Winter 2011

We emailed/skyped back in forth until he came in Summer 2012 on a touristic visa

He stayed from summer 2012 until winter 2012 (4 months)

Winter 2012 I went to visit him and meet his family (2 months)

March 2013 he came back to the US on a touristic visa

We are just about to get married.

08/17/2013: Received Hard Copy of interview notice

08/20/2013: Received status update e-mail saying combo card is being mailed!

08/22/2013: Received Combo Card in the mail smile.png

09/11/2103: AOS Interview at 10:50am!

09/11/2013: APPROVED!! good.gif

EAD is routinely approved for someone with pending AOS. It would only be denied if you failed to reply to an RFE or replied improperly (and the whole AOS would be denied).

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

The employer doesn't need to know (and is generally not allowed to ask) at the time of interview / job offer. On the first day of the job when he completes the I-9, he will need to show the EAD. They must accept it.

The employer cannot discriminate, and should not even ask; they should simply be ensuring that he has the right to work within the United States.

The I-765 application is very routine when filed based on a pending I-485 application - it's simple to adjudicate and, so long as there are no RFEs which are outstanding prior to the production of the card, will be issued within 90 days (usually) of filing.

Day 38 - May 18th, 2013 - EAD card arrives in mail!

Day 41 - May 21st, 2013 - I-485 updated to "Testing and Interview"

Day 51 - May 31st, 2013 - Interview scheduled for July 16th, Dallas

Day 62 - June 11th, 2013 - Started work as a Systems Engineer (IT)!

Day 96 - July 16th, 2013 - Approved at interview in Dallas, Texas! (I-485)

Day 96 - July 16th, 2013 - I-485 updated to "Card/Document production", I-485 updated to "Approved, mailed welcome letter", I-130 updated to "Approved"
