So what's next we just finished with the bio's on monday the 13th, got all of the NOA1 for AOS,Work perment and travel perments, will we still go for a interview or will they just send the green card and work and travel perments? Also how do i adopt my step daughter want her to have my last name and want to change her first name being it's Jhana Mitch and she goes by Jamie. what do i do about that? Thanks

Your wife should receive her work (EAD) and travel (AP) permits in about a month or 2. It will be a combo card: EAD with an AP note on it.

Yes you will still go for interview after you have received your working permit

No necessarily. As the OP's wife is adjusting from a K-1, her case may be waived from an interview. There's about a 50% chance that she or she will not get an interview. There is nothing to do right now other than waiting. She will receive a RFE, a notice to appear at an interview, or a straight approval/denial.

If the case is chosen to be waived from an interview, the wait is pretty long (up to more than a year). The case will be adjudicated at NBC.

If the case is scheduled for an interview, it is usually done fast (a month to a few months after biometrics). NBC will transfer the case to a local USCIS office where the interview will be given.

About adopting your step-daughter and changing her name, you should inquire about it at a courthouse.

Also, I would not recommend to your wife to use her travel authorization. From your timeline, it seems that she overstayed more than 180 days (date of her I-94 expiration, on her passport --> date on her NOAs for AOS/EAD/AP), so it would be very risky for her to travel with her AP. She may be refused and banned for 3 years when she would see entry back to the US with her AP. Best would be to wait for her green card to travel out of the US.

Thanks for the info! As it looks at the moment it will be another year or so before we can go anywhere outside the country like to the philippines.

why does it take a year or more if they decide not to have an interview ? To me not having a interview would mean they like what they see that i can take care of them and we are legit? either way we are ready!

It's not about what you sent and if they like it or no, it's more about how busy is your local office. If it's busy, chances are that your case stays at NBC (they are loooooots of cases there). If it's not, then you are scheduled for an interview quickly.

My case was pretty simple, no divorce, no kids, no red flags, but I was lucky that my local office was not busy, so I got an interview and my green card quickly.

Just wait and see. :)

I see, on mine I've had two divorces and kids with the first wife but their just about grown now but my wife now has a daughter. The second wife was from the same country as my wife now and ran out on me after a year and a half? So far everything has moved pretty fast except me on getting this part done(the payment and filing for AOS) But as far as red flags i'm asuming you mean RFE's? haven't had any of them to slow us down as of yet? so were ready for anything that might come up? Like you said wait and see. Thanks

Got the employment cards in Friday the 21st even my 8 yr old step daughter but didn't get anything else? checked the status for the travel they said it was approved and was sending the letters out on the 13th of june but still haven't seen them yet? also nothing about a interview yet either. anybody know what i should expect or do now? Thanks

The EAD is a combo-card. Check at the bottom of it, there should be a note saying "Serves as I-512 Advance Parole".

It doesn't mean anything. EAD/AP are routinely approved in 2-3 months.

The AOS has a very different timeline. If no interview, be prepared to wait a long time without any news. If you are scheduled for an interview, it may be in the coming weeks/months.

last thing i have heard was back in April 11 2013 still nothing on a interview or greend card called the 1-800 number and they said it was in Missouri and that's all they know ?????????

is there anyone else we can call?

Sounds like you are being approved without interview and the waiting times for that can be 10+ months. Check the AOS progress forum for those that filed at the same time as you to see if others are still waiting. If they have not interviewed, then they most likely are.
