I485 is under extended review!!!???

Hi vj family.

This is my story. I came to the USA in may 2012 with a waiver visa

I got married on August 14th 2012. Immigration received my papers on September 5 2012. I had a few weeks later my fingerprint appointment. Then I got my work permission card and my Ssn on November 24th.

Our interview was January 10th 2013. Everything went well with the interview. All basic questions. Nothing to worry about. At the end of the interview the io told us that we will hear something in 4 weeks. . BUT after the interview I have not heard anything. We did 2 service requests. And 2 info pass appointment with no results. We don't know what to do!! It's now almost four months after our interview. Nothing yet!!!

So my lawyer went last week for a second info pass appointement. They told him that my case is under extended review!!!!!!

What does this mean? What can we do?

Contact one of your congressional representatives to enquire on your behalf.

It sounds as if it might be in-country AP. This would be more likely if you have an Islamic or Muslim name.

Thanks for your reply. But what does this ap!? Mean? And yes I m born as a Muslim lol but don't see myself as a Muslim. Btw my wife is Christian.

And I am a European citizen.

Sounds as if you are in mandatory in-country AP. This can take weeks, months, or rarely, years, before it is completed and your visa (or in your case, AoS) is granted.

Basically, they are checking that you are not a terrorist or have links to people who are. This was brought in after 9/11 as part of the PATRIOT Act.

Probably due to your name being similar to someone on a watch list.

If it drags out beyond the validity of your EAD and AP (hopefully it won't), be aware that you are entitled to free renewal of the EAD and AP. I'm not sure whether you have to mail off an application for that, or go to an InfoPass appointment.

There are other reasons to be under AP besides name checks. Highlighting that as the only reason makes a false impression. They do AP for fraud and other things as well.

why doesnt it? im not saying they did anything wrong and they probably didnt intend to marry and stay and adjust status it just happened that way......but the way that immigration is now days they look at anything and everything........

Intent can not be used as the sole reason to deny. Exceedingly unlikely that is the cause of the delay. OP, please keep us updated on your progress (or lack thereof), it's cases like this that help everyone...
