Hello everyone!

i have been looking around the website and really saw a lot of helpful info on here about how things work in regards to VWP and AOS switches and such but wanted to see how it would affect with me being active duty military, my fiance and i have been together for 5 years i plan to bring her to the states as she is in a country that is VWP eligible, we do have the intention of marriage but she does NOT have the intention to stay. Now just in case she changes her mind i read somewhere there shouldnt be a problem as long as we file for the AOS BEFORE the VWP expires, so i'm just wondering how this may affect me as i am in the military? would it help out at all so they wont see it as a fraud? we have pictures and such to proof that we have been together for a long time. I'm just really trying to head the right way with this and try to not take too much time. Any info is greatly appreciated! thanks!

Being in the military does nothing for " wont see it as fraud ". There is lots of marriage fraud in the military, weather its the immigrant frauding the US citizen military to get into the country or its both USC doing it for the extra pay being married.

But active duty military sometimes are processed faster than regular petitions.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Thanks for you reply, i guess what makes it different is that we have a backdated relationship for 5 years and proof of it as well.

a "back dated" relationship doesn't mean anything if she comes and adjusts status. Just the mere fact that you are thinking of it now, that it could be a possibility that she comes and adjusts status is intent.
