Hello all

I posted this information once already on a different thread....but I didn't get any replies. Maybe I'll have better luck here!

My wife got her B1/B2 visa 3 years ago, when she was not my wife. She has visited twice so far, and we were hoping to visit again this year. We were married earlier in 2013, but we have not applied for any paperwork (residency, green card, status change, etc). Does she still have the travel visa? She has not been notified of any changes, but the more I do research online, it seems like the more questions I have (and I'm not getting many answers :( )

Any help from this forum--either answers or places where I could look/contact--would be very much appreciated!

I assume she still has it as long as it hasn't expired

What are your plans? Do you intend to move to her country or move her to the US? Have you filed any paperwork for a spousal visa?

since originally posting this thread, i have US embassy members telling me that we can enter the country with no problems. i also have a retired immigration lawyer and an person who works in a consulate office telling me that my wife needs to reapply. nobody seems to know the answer for sure: can my wife still enter the country with her old travel visa if we got married outside of the US?

we plan on filing for a CR-1 Visa in the next year or two, and i want to make sure that her entering the country on a travel visa while married won't mess that up.

thank you for the replies, all. just spoke with an immigration lawyer, and she told me that while the visa has not been revoked, there's still a good chance that she could be stopped at the border and sent back if she is traveling with me. the reason is that it is assumed that she will be trying to stay in the US beyond the month that we would like to be there. she also said that if we could compile compelling evidence of a return trip, that we could present that at the border, but that it would still be a risk. she said that i should talk to the US embassy for more information, but i'm not sure where to start with "compelling evidence." a work contract?

The lawyer you spoke to is stupid. Trying to scare you so you buy his services.

What country is your wife from?

Agreed she can enter with a valid visa but do not overstay or you will have a problem with the next steps of the process.
