I asked for one and that is the person who told me all the nonsense. I even asked her if I was going to get my original documents back that were sent to NVC and she told that I wasn't suppose to send originals. I told her that copes are sent to USCIS but originals are sent to NVC. THEN she said that he was suppose to take the originals with him to the interview. I told her that is not how it works, that I had to send the things into NVC and then they send me a sealed package for him to take to his interview. She replied, Yes. I said, wait a minute, you just told me not to send originals and then when i told you how it REALLY works than you agree with that, which is it? Then I told her that I cannot believe that not only does she work for a government facility that is suppose to be able to help me with these things and answer questions for me but she is a supervisor and how NO idea how the process works. I asked her if she an I-130 adjudication supervisor and she said that there are many supervisors and they all do a little of everything and there was no supervisor just for that. I did EVERYTHING that Darnell told me to do and these people were just complete MORONS!!! I called USCIS AGAIN yesterday and they transferred me to a tier 2, whom barely spoke English and i couldn't understand him so he transferred me to a person higher than him. This man now told me that the 30 days I was quoted for USCIS to get my file back was wrong and it usually takes 60-90 days for this. There was an inquiry put in and it has been assigned to a worker so I should be hearing something about that soon. I also made another infopass appointment for next Tuesday. These people are going to get sick of seeing/ hearing from me!!! I am also going to apply for help from my Senator. I will keep you guys updated and welcome any more help or suggestions.

Having worked for local government before, may I politely suggest that insulting the people who are responsible for moving your application forward may not always be the best idea? It sounds as though you are having a reactive response to things that are being told. One trick to prevent that from happening is to listen what you're being told, take a few breaths before you respond, then respond. It can dramatically change the tone of events.

That being said, and not to beat a dead horse, I just read this entire thread and I see how easily the information you've read has been just slightly misinterpreted. The about.com website is not official government information, it's a series of people who are deemed "experts" trying to explain a confusing set of US laws. I know that when my I-130 was approved at USCIS, I got confused and thought that was the official approval... and then I figured out that it was a first of many things to come. Even the official sites are very confusing, like the information from Morocco, which requires a court clearance and a police clearance (I got the same checklist for my husband as Ismael & Blair did, super frustrating!)

There is no set number of visas for spouses of US citizens, however, there are finite numbers of worker visas or visas for brothers and sisters of US citizens. The distribution following approval of these visas is based on priority date, and in many cases takes up to 10-20 years to actually obtain the visa.

Hopefully your case gets moved along quickly, but be mindful of the tact that you take, they do log calls and site visits. And while I don't think it's right to do something like this, I wouldn't put it past them to also be logging their perception of your interactions with them. What's the old adage? You attract more flies with honey than with vinegar.

I agree with you 100%!!! That is why during the first hour of our conversation I was EXTREMELY nice and patient with this woman, explaining the situation over and over and showing her document after document and speaking slower each time so that maybe she would understand what I was saying. I even calmly told her that I didn't think she was understanding me at all. It wasn't until after it was obvious that hse had NO idea what she was talking about that I really became frustrated and even asked to speak to another supervisor but they wouldn't allow that. One of the major things that I do not understand is how I can call and more help from them and they tell me to go to the field office for more information that they do not have access to but then the field office is totally clueless. At one point she told me that my case could be with another supervisor in that office....WHAAAAT??!! In THAT office and there is no record of it anywhere??!! Someone please explain THAT to me. I do apologize, I am very sensitive right now. Not only am I having to deal with this BS from the government but my SIL that lives with and was 35 weeks pregnant lost her baby on Saturday and she just delivered him today. It was my youngest brothers first baby. Not having my husband here to help me through all this has been extremely difficult. The officer I spoke to yesterday above the tier 2 worker was extremely confused by my case and he didn't even understand what was going on. He said that he saw no reason what so ever for my case to be returned and that their office do NOT request but that this is not the first time he has heard that NVC has put the blame on USCIS. I have even contacted the Department of State and they no nothing.

On a POSITIVE note, NVC did return ALL my original documents to me so we don't have to go through the time and more moeny to repurchase these. That I am grateful for. I really do not understand how out of 3 agencies none of them have my file and none of them know what the problem is or where the file is. This is more than shady to me!!! I will be making a lot of noise now with my state officials cause I am sure I am not the only that this has happened to and it needs to stop. I am all for rules and guidelines for immigrants and strict background due to all the attacks our country has had but this is just past ridiculous already. My husband has studied law and is even more determined now to practice immigration law here in the States to help people like us. Thank you everyone for all your support.

OK, here is my update, I went to the immigration center on May 21st like I was instructed to do. I encountered some of the most supidest people ever to walk the face of this earth!!! She even told me that my husband cannot apply for a K-3 visa until we have been married for 3 years. I even know that is not the case. It has been over the 30 day period that was stated to me to be back in USCIS system. She also said that I filled out and submitted the wrong form for my joint sponsor but I did not cause he his also a household member. I scheduled another infopass for next Tuesday to try and get something out of these people. Any other suggestions will be great and thank you already for all your help!!

so - you got 'the first person' then you asked for the floor supervisor

and then you asked for the I-130 Adjudication Unit Supervisor, right ?

That's 3 humans, minimum.

Did you, at least, confirm that the casefile was back in their office?

but - you not want the floor supervisor for resolution.

ya gotta get the floor supervisor to get to the next supervisor, the I-130 adjudication unit supervisor. That's a real title, there's a real human attached to it. When you return, get that human. Take your time in doing so, be prepared to wait until that human shows up.

I had some results with that, but in the end, for me, it was my Congressional Immigrant Liason Staffer that fixed a lot of silliness at the local office.

Darnell I asked this woman to see that EXACT supervisor. I even had the paper with me that had all your steps written on it lol. Her response to me was that ALL the supervisors are I-130 adjudication supervisors. They all do everything and there is not ! specific person that has just that title. I understand that you are saying there is, I am just telling you what this woman told me. She really didn't know anything about anything. Makes me think that maybe I should apply for a job there such you really don't need to know anything about the process to be qualified lol. J/K people!! Relax!!

Darnell, maybe you can help me with this one. When I called into USCIS they transferred me to a tier 2 worker. He then transferred me to someone over him. When I talked to him I explain my situation and he had mentioned that I could apply for emergency circumstance to get it approved quicker if I had some kind of physical or mental illness etc. I told him that I have suffered from major depression since I was 15 years old and eventhough I am doing good now and only on meds for my anxiety, this ####### that these people are putting me through is really making it worse and I may have to go back on medication because of it. He said that would be a great reason and to use that. I had seen/read somewhere about doing that but now I cannot find how to do that. I think I had to call or write to another department but for the life of me cannot find any info anywhere. Would you happen to know where I can find this information so I can begin this process as well??

i suggest no expedite due to anxiety or depression, really.

engage yer congressman's immigration liason staffer today, they can start the inquiry at the local office tomorrow.

your local office has a human dedicated to congressional inquiries - so at least it'll be 1:1 linkage on the human asking the questions and the human giving the answers.

After accussing my husband of being a fraud, they did an investigation that took aprox. 5-6 months and have found the claims to be unfounded. They have finally sent my petition back to NVC to finish out the visa process. However, circumstances have changed in our family so it will take longer than the usual time frame for us to get things processed. I'm extremely disappointed in my government to say the least. The Congressman's Imigration Liaison has been an amazing help to us and even she could not understand what Immigration was doing. They kept giving me false information. I am extremely grateful to her but at least now our journey to bringing my husband home can continue. Good Luck to ALL going through this process!!!
