Someone to help this young couple

Hello everyone on VJ forums.

This is Wei (petitioner, US Citizen) and LoLo (beneficiary), to make the story short: We got everything done about immigrant visa, BUT only one thing is missing, my husband Wei does not have enough income to be my sponsor, why? Because he just graduated from University, he worked in the past but of course it wasn't a career job, so no good income. He is 24 and I am 23 years old. The officer at the embassy told us to find a joint sponsor. We could have avoided this situation, but we have done all this process by ourselves, no attorney help, only reading information in this and other websites. We have asked his parents and friends but they say that's not their responsability, but we just want a little help :(.

So please anyone out there, if you know how to find a joint sponsor, we are willing to do our very best to avoid problems. We are young and responsible people and we will return to anyone to help us, the huge favor!!!!

I know it is so complicated to do this, but we all have been in the same process and the struggle, only we know how hard can it be. Being away from your love.

How much time does Wei have to turn in a new set of I-864 documents?

Does Wei have any assets as well, that can be shown on the I-864 ?

No stranger will help because of the big responsibility involved. You will have to find work and support yourselves. If you are good members of a church try there maybe to find someone to help

To Fight for Love: It will really work out? He's trying to get a full time job, so it will be enough. That's my doubt: how much time it takes to show that he makes enough for sponsor me?

tax paystub? what is a tax paystub?

I know paystubs, but tax paystub?

to show 'current annual income' - one needs a letter from an employer. Those are easy to get, once on the job.

to show income tax stuff - that's always prior year - so plan to wait until Wei can file for Tax Year 2013, sometime in January 2014.

as long that he found a full time job with hourly rate of $9.50. you guys will able to meet the poverty guidelines.

$ 9.50/hour x 40hrs/wk = $ 380

$380/week x 52 wks per yr = $ 19,760.

means that's more than enough.

it depend if he gets paid every 2wks then he needed to wait for 1 month to collect 2 pay stubs. or it he gets paid per week then 2-3 paystubs should be enough. but make sure to ask him to get an employer letter that it will indicate that he works full time job and the job is permanent.

up to a yr??? then your hubby have enough time to look for a full time job and I suggest to wait for few months atleast 3months to collect paystub. so that the embassy will honor it. usually up to 3months the employee is still under probation to be entitle for permanent job. but it not necessary it all depend which company.

Sorry, I meant the current annual income. But for the AoS they request only the income tax right?

another thing Darnell: Can I apply for a visitor visa? If I applied already for immigrant visa? Thanks again

no, for i-864, they look at prior year tax data and current annual income.

prior years tax data is show on income tax returns.

current annual income is shown from an employment letter from an employer.

MAYBE the ViceConsul not worry about prior year income IF the employment letter speaks of a 60 to 90 K/year job.

maybe. They have some discretion about this, so bear that in mind.

Can tell us, exactly what was written in the papers the ViceConsul gave you at the interview ?

Also - what did Wei do at the University at the job placement office, the last 2 semesters ?

Well the letter says when I get all the evidence mentioned send the documents, which is AoS from a joint sponsor with w2 form, tax form (1040) and proof of citizenship. Under 221 section(g) so yeah. The best to do is my husband to get full time job ASAP?

So what can you tell me if I could apply for a visitor visa?? Thanks

you could certainly apply. it's doubtful it'd be awarded/given, based on your current status with the DoS .

your free to apply for visitor visa. but it might get denied due to pending case with them.

but ofcourse its always a good idea to give a shot than doing nothing. if they denied or not atleast u tried.

Well let me tell you guys, the officer was pretty nice to us, I don't know! Somehow they might understand the situation, since my husband has to get prior year tax income and that means not coming to see me :( then I can't go to see him neither? No wayy.. *heartbreaking*
