Hi VJ Members,

We filed our I 130 in April, less than a month ago, I am planing in going to visit my husband in El Salvador for two months. I know that we have to wait around six months to receive the NOA2, my question is, if we were lucky to get our case touched and being requested for evidence of a bonafide marriage, while I am outside the US, could I be able to mail it from El Salvador?

Thank you in advance.

You should be able to as long as the evidence gets to the USCIS office on time.

As long as it gets there intact, it doesn't matter where it came from. The problem is you're going to need to send the hard copy RFE letter they send to your US address, along with the answer to the RFE. You're going to need someone to check your mail and somehow get it to you in order for you to be able to successfully mail off the required documents.

It can and can NOT be an issues, first if you added the G-1145 notification to your pkt and you are able to rec'd text msg. while out of the country, or have access to the internet it should not be a problem as this updates you about the status of your case.

Now hypathically speaking if you case is actually "touched" sooner then the time expected the only thing is when their is RFE it is mailed out to you, and why you rely back to it they enclose a "blue" sheet of paper that must be placed at the top of your reply, so someone who can take care of your mail while you out thats a plus. Otherwise you will have to wait until you come back.

Just as a note, you're not really wanting to get an RFE. That's not a positive thing unless you've been waiting a very very very long time.

hi NikiR

I totally agree with you, but I think that I could receive RFE because I did sent only the marriage license :( We don't have a bank account, life insurance nothing showing both names. If that happens we only have pictures together.

Oh that explains why you're waiting for the rfe. Adding a spouse to car insurance is pretty easy. Banks you have to shop around until you find one that will do it. We didn't have too Mich trouble but hubs is with USAA which is a military bank and used to foreign spouses. I have heard people have had good luck with bank of america though. I assume you send emails or use skype and you can use that for evidence as well. Or if you snail mail, letters with envelopes.
