I-485 Processing Times

Hi there

My I-485 and I-765 have arrived at the California Service Center and the I-765 is in initial review.

I was checking the processing times for the I-485 and it is averaging 23 months. Is that true?

I have a couple of other questions but that depends on the answer to the above!

R-1. Expires in July.

I-360 approved for Special Immigrant Religious Worker in Jan this year. Only filed now as I had to travel and no guarantee I'd get I-131 in time.

I don't think we have a lot of data here on self-adjustment from R visa. Though the figure you are looking at is not, I believe, for your situation. I think that is for adjustment via I-140.

From previous conversation, it seems that the EAD would remove restrictions on the R-1 which would then leave me open to pursuing other employment options and not be tied to my current employer. Is that right?

I was just worried if so, if that meant I had to stay in my current employment throughout the duration of the AOS process.

Once you have the EAD then you can work for whomever you want, wherever you want, doing whatever you want, until the expiry date on the EAD (or until your I-485 is rejected, which would automatically invalidate the EAD).

You may want to double-check with an immigration attorney first, as adjustment from an R visa may have special conditions that we are unaware of. That isn't something commonly seen around here.
