Form DS156 for interview

Hi there !

I am starting to fill forms before receving packet 3, just to be reading when i receive it probably in a few days.

I have a history of overstaying the VWP for like a month, i didn't get any ban but cannot use the VWP ever again . I never knew this so i tried to go back to the US on the VWP and was denied entrance, lucily it happened in customs in canada so i wasn't deported, the immigration officer at that time let me know that it wasn't dramatic that i just need a visa to enter the US now. Later i applied for a B2 visa that was of course denied, the CO tld me it was denied because of my lack of ties to my home country, which is true and didn't say anything about that.

Unfortunately because of that i am going to have to answer Yes to one of the question on form Ds156 (the one that asks of i was ever denied entrance). How bad is it going to affect my visa application? Has anyone ever been in the same situation as me before?

Always say the truth. They have records available, and if you lie they'll deny you.

If they ask to explain, then tell them what you wrote here.

I don't think it's going to affect you much, you did nothing wrong except the one overstay on the VWP.

Thank you very much. Yea i had planned on telling them the truth, i never planned to lie about this.

I am putting this topic back up since i have another question concerning this issue i have. I am going to answer yes to the whole question but only one statement in the questions is really "yes" for me. All of the other statements in this question have "no" for answer. I don't like the fact that by answering yes to one specific statement I am answering yes to all the others.

So do you think i can add a note on a separate sheet with my DS156 to explain that only the first statement of this question concerns me and that the answer to the rest is still "no". Also i could use this to explain what happened, how i got denied entrance that one time as i travelled on an invalid ESTA so hopefully i don't have to talk about it during the interview (as the memory of this event usually get me in tears)

Yea as denied entries go, i think this is really no big deal, im no expert but i really dont see this being a problem for you, if i was in your position i would attach a page explaining why i answered "yes" but keep it factual, and dont point any fingers

I guess this is what i will do, i will attach an extra page (hopefully they see it). and hopefully they don't ask me any question about this during the interview.

I find this crazy all these statements in one question, because all of them may not apply to you. At the same time i am answering yes to trying to get a visa using fraud and idk what else....

Here is what i added:

I have answered “yes” to question 38, part 2. I want to specify that only the first statement of this question has “yes” for an answer. I was denied entrance to the U.S on ..... in the Toronto pre- clearance customs while using the VWP that I ignored I was not eligible to use anymore. All of the other statements of this question have “no” for an answer.

I had a similar situation. I checked yes. No questions asked, visa got approved this week. I also attached supplemental sheet for question 29 because I had more visits to the US than there was a room for enlisting and they did not even take it,they gave it back to me although it was all nicely stapled together. The worst thing you can do is to try to hide something. They are honesty freaks.

I am glad that someone in a similar situation can help me. So i ll attach that extra information sheet and if they don't ask any question i am glad !

However, you will notice that in the first question there are "or"s. Answering 'YES' to an or question does not mean that you are answering 'YES' to all conditions. For example, "Are you female or overweight?" If one is male and overweight, then a YES answer is appropriate for the question and it does not change one's gender.

Yep this is the question... i noticed the "or", however if i don't specify which one it is how are they going to know? They could look down on me just for that.

Also does this lead me to answer "yes" to another question, the one that says, "have you been in the US illegally" since i overstayed the VWP for like a month.

2 yes , i really don't like that....
