Hi Folks,

My fiance is a member of the Union de Jovenes Comunistas (UJC) - Cuba's youth communist organization. He joined around age 15, in high school I think. He is not active in the organization though. We've just gotten our NOA2, approval from the National Visa Center, and are about to schedule an interview for the fiance visa. I have read that it is a common question in fiance visa interviews - whether or not folks were part of the UJC.

For the Interview

Should my fiance resign from the UJC asap? Or should he just be prepared to explain his membership as something ordinary at his high school?

DS-230

On the DS230 form, there is a question:

c. An alien who seeks to enter the United States to engage in espionage, sabotage, export control violations, terrorist activities, the overthrow of the Government of the United States or other unlawful activity; who is a member of or affiliated with the Communist or other totalitarian party; who participated, engaged or ordered genocide, torture, or extrajudicial killings; or who is a member or representative of a terrorist organization as currently designated by the U.S. Secretary of State."

Should my fiance mark yes to this? He is not a member of the Communist party, but rather the youth Communist organization.

I've seen questions like this asked with respect to other countries, but am looking for info specific to Cuba.

Good morning, I cannot say for sure if this affiliation will affect your specific situation. But here is what I do know, you are requesting a K visa which is a temporary visa. Eventually, when one applies for an adjustment of status, the beneficiary past activity is evaluated. They may deny based on the grounds of "prior criminal convictions, affiliation with unsuitable political parties or organizations (e.g. former members of the Communist Party), poor character or debilitating health problems".

All you can do is tell 100% the truth. If they participated or were required to join in order to obtain entrance to the University, etc. then say so. If you they withdrew their affiliation (which in Cuba you can do without suffering the backlash that once was very extreme), then state it. You can never go wrong with the truth. I've read posts on this site under Embassy Review, where couples went to their interview and were asked this very question. They told the agent that they had been part of the party but where no longer. Some of these individuals were unemployed due to their withdrawl. However, this did not impede them from getting an approval. I guess my point is, always say the truth.

My man also joined in grade school -as was normal and expected of students. When we started learning more about this process, he withdrew his membership. He is not interested in the mission of the organization - as you know it is comparable to being part of the boy scouts here! I don't have any evidence to back this up, but I think you are better off discontinuing membership. This way if asked about it, you can say, "as a child in school, we were expected to join. As an adult, I choose to disassociate myself."

I am curious what was the outcome were you approved ? Because of the usc ? My husband was in it to when he was young and got out of it real quick and we are on ap status for 3 months now pleas reply I hope we are not denied for something that was years ago I still have hope cause they still have his passport at the embassy and on ap status
