Hello,

I am a US citizen who is sponsoring for my mother. My petition was approved and her interview is in a couple weeks.

I am filing out the I-864, but I have never filed taxes as I have never been employed.

We do have a joint sponsor who meets the financial requirement.

Are there any documents that I am required to submit with the I-864 as proof as to why I don't have any tax returns?

Is a letter saying that I've never been employed sufficient?

Thanks

Depends. IF you have never been employed and have not had any earned income AND you do not have any investments that cause you to go above the interest or dividend threshold AND have no capital gains or income property then you can show how you are not required to file an income tax return. I would find the "Who should file a tax return" on the IRS website and hit all points in your letter. Otherwise the USCIS will expect an income tax return as it is their feeling that all LPR and USC must FILE a tax return every year. Another option is to file the last three years tax returns with the IRS and then include the transcripts with the I-864 form.

Good luck,

Dave
