Timeline

I was wondering how long does this visa usually take,,, right now i am gathering all papers/receipts/pictures for the package.. i know the K3 is not an option anymore.. so i'm going to fill out the I-130 form and I will really appreciated if someone could tell me how long does it take so i can bring my husband to USA. Also should i change my last name before starting the application (i will have to change my Social Security card, Drivers license, Passport, citizenship certificate etc.)

Or should i do this thru a lawyer so the process will be quicker? Please advice me before starting this. Thank you!!!

09/20/2012 -> Check cashed
09/24/2012 -> NOA #1 letter received
10/05/2012 -> NOA #2 letter received
10/26/2012 -> Biometrics appointment
10/29/2012 -> Placed in line for interview
01/04/2013 -> Interview letter
02/05/2013 -> Interview (approved)
02/22/2013 -> Oath Ceremony!!!

Hello! It all depends it usually takes 1yr or 1 1/2yr all cases are different. Some ppl do it themself if is not complicated others just rather get a lawyer, but you should always try and get different opionions from lawyers in reference to your case. Has your husband ever been in the states?

No one can really say but its always wise to prepare for 8 to 12 months. Could be less could be more.

Also if you want a lawyer that is your choice but having one in no way speeds up or lessens mistakes. Some thing lawyers have the fast track through processing. You will be in line like everyone else just to let you know.

Alot of things with immigration is popping up this summer so if i was you I would get my petition out soon before you are in a pile in a box on a shelf for the next year.

though am planning to send in my application by july, but can u pls share with us what might be coming up in relation to spouser ect visa and how they might affect what we have now?

Like Dwheels said, it takes an average of 8-10 months.. As far as I know, you do not have to change your name on anything before starting the process.

If your husband doesn't have any criminal records or any previous visa over stays then I would suggest you do not get a lawyer. It seems that in many cases the lawyers actually SLOW the process down, but I am not speaking from personal experience, only from the many threads I have read on VJ regarding complaints on lawyers.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I never changed my name, but I was told by our lawyer that if I wanted to that I should go ahead and do it before hand but absolutely not DURING the process. So I guess before or after, doesn't matter, but not during because paper work gets too messy. We used a lawyer, it was expensive, we still had to collect lots of documents and I did the translations myself, but everything was submitted in a timely and orderly fashion. I think if you already have this site, then it's not necessary at all. Our case took exactly 12 months from initial submission to receiving green card (2011-12)

I used a lawyer. But as some one else said you sill have to gather all the papers yourself, Make sure they are translated, ect. I found this site after I filed. It allowed me to be more on top of things and I had all our papers ready for the NVC before the lawyer asked for them.

The big help was at the USCIS. I work a lot of hours and didn't want to miss something. As long as you double check everything you should be fine. The lawyer only speeds things up a little at the NVC. Because you don't have to send in the Choice of Agent. But if your lawyer is like mine he will wait till the invoices show Paid before sending in your AOS and IV packages. I think it's all a personal choice and how much time you have to focus on the small details. Plus make sure you have a good lawyer. I visited two in my home state that didn't know where Turkey was.


USCIS - 66 days ROC - 139 days from sent to approved
12/3/2012 - I-130 delivered to Chicago 5/20/15: mailed I-751 package to California office
12/4/2012 - NOA1 NBC (Missouri Service Center MSC) 5/22/15: Date on NOA1
12/6/2012 - Check cashed 8/26/15: Bio appointment

12/8/2012 - Received paper NOA1 10/06/15: Received Email card was being processed
12/20/2012 - Case number showed up on USCIS website
1/29/2013 - Called USCIS and case is still at NBC
2/8/2013 - Received an Email that we were approved on 2/7/13
3/5/2013 - Told file may have been "misplaced" to email NOA2 to NCVresearch
3/7/2013 - ISO at the USCIS opened a service request to try to track down
if and when the file was shipped. Should hear something before 3/26 ( so she said)
