Brother (over 21 yrs) of legal resident moving to US?

Hi, I have a question. My husband (us citizen) and I (legal resident) and I were talking to my brother and he would perhaps like to move to the US. I am just beginning to look into the paperwork and I am unsure how to go about this. Could my husband "import" him as his brother becauses he is his brother-in-law, or would I have to do this because he is my brother? And what is the petition called? What are the waiting times? Is it difficult or just a formality of paperwork and waiting times?

If anyone can answer these questions for me or direct me to the right place, I would be most grateful.

Only US citizen can petition for his/her sibling. When you have your citizenship, you can file I-130 petition for your brother. Wait time (current) 10-11 years for most countries except Philippines and Mexico.

There is no brother in-law visa. The only person that can petition him is you as a US citizen or his parents. It will be many many years to petition him.

As others stated, you will be able to petition your brother when you become US citizen. You mentioned your brother is over 21 so you also have to think that by that time your brother may be married. You will have to show you can support him and any spouse he may have by that time (in case is he married by then).

Yuo have to wait until you are a citizen to file IF that visa class doesn't disappear as part of immigration reform. ( It is one of the ones they want to get rid of ) If you get to file the wait i from 12 to 23 years depending on where you are from

This will not be over quickly. You will not enjoy this.

A brother-in-law is not a brother for US immigrations. No one can file for an inlaw, so your husband cannot file for his brother-in-law.

Only a US citizen can file for a brother. Once you become a US citizen, you can file for your brother. The wait us 12 years for a visa.

Has he looked into schooling ? He could get a visa to come to the USA to go to school.
