Hi guys,

Right, the I-864 - Aff. for support required for AOS.

Here is my quandary.......

My future wife is working at present making the required amounts etc

When i come over, i have immediate employment, and she would like to go back to school, start a family etc.

My income will meet all requirements etc, so, is it based on household income or her income?

I hope someone can shed some light on the situation!

the I-864 is for the USC as the sponsor.. so her income..



are you entering country.. after or before I-864 is filed?

I'll be entering before it is filed. And, at that point i won't be working, due to EAD requirements.

My job will be more than sufficient to cover the numbers.

Reading the form, it asks for the US sponsor to fill it in. At the time of filing it will be correct. Upon review, there will have been a change in circumstances.....

Thats my issue. They will review a correct form at the time of filing, but however long down the line it may not be. We will still be able to meet requirements etc, just in reverse.

If she is working and makes enough for you to adjust status, then you get your greencard. They won't be asking for updates from her, whether she continues to earn enough. It's done at the point of AOS. She is still responsible for you, but it sounds like your eventual job will keep the family financiall secure and off means tested benefits. Sounds fine as long as she doesn't quit work before your GC is granted.

Are you asking if you go to the AOS interview and she has already quit her job, but you have gotten EAD so now have income, will that pass? It's kinda risky because timing never happens like you think it will. In theory, maybe. But you don't want to be mucking around with your greencard approval.

And there lies the problem. She will quit work before the green card is issued. She is going back to school. But only when I am employed, keeping the household income level up.

Could she get part time work to keep her income to cover the required amount? Or could I employ her?

Could i use a co sponsor?

Absolutely. You didn't say what your employment will be. When you said "could I employ her?" it sounds like you plan to be self-employed. That is harder to prove. What's the plan?
