Expired I-94, Can we still apply for SSN?

My husband came here in the US through K1 visa. After our wedding, I immediately started gathering all documents needed for his AOS but I never thought about applying for SSN for him as I thought it is not needed until after his AOS. His I-94 expired almost a month ago. He just had his biometrics done a few days ago and I just learned today that he needed an unexpired I-94 to apply for SSN. My question is, is this going to hinder his AOS process? will we still be able to apply for his SSN is the future? or is there any other way we can get him a SSN with an expired I-94?

You can apply with your EAD once you get it.

Rossana was not allowed to get a name change on SS card.. since her i-94 was ABOUT to expire.. apparently.. you have to have at least 2 weeks still valid.. they told her to come back after she got green card for name change for marriage..

i am sure you will just have to do the same..

It will not affect his AoS, but he will not be able to apply for a social security card and number until he has either his EAD or green card.

AOS was approved in 2 months and 8 days without interview.

no, you won't be able to get SSN or state ID if the I-94 already expired, it happened to me because my husband was think, it's not really necessary to get SSN yet as long as i won't go to work but finally i got EAD / AP and get SSN already & it won't bother AOS process

AOS timeline 2013

Feb 21 Sent to USCIS

March :

06 USCIS got the paperwork

09 Got NOA from USCIS

25 Biometric

May :

02 Received Combo Card ( EAD & AP )

06 Medical Checkup form I-693 ( including new X-ray )

08 Medical Passed & got form I-693 sign by Civil surgeon

15 Interview

18 Card production

23 Got my 2years GC dancin5hr.gif

24 SSN & ID card applied

No More USCIS til 2015
