First of all I am happy and excited that my I-130 IR1/CR1 is approved in about 4 months. Now I am moving to the next stage, NVC.

As a background, I applied for IR1/CR1 (I-130) and K3 (I-129F). I received approvals (NOA2) for both on the same date from USCIS…quite confusing since I read from other posts from VJ that K3 is dead. I am getting ready to submit I-130 forms relevant for NVC as soon as I get the case number.

I am not sure what I should do with the K3 approval? The approval notice doesn’t say that it’s going to NVC and instead says that it’s going to the consulate…quite confusing….as I thought it goes to NVC. I am planning on calling NVC and asking them about it….any suggestions? I am assuming NVC will abandon it very soon if it did get to NVC. Also, nowhere in the approval notice it states K3, just says I-129F since it’s the same form for K1 and K3. An expiration date of 6 months for the approval notice is printed as well, which might hold significance for K1 but is irrelevant for K3. Did anyone end up in the same boat recently? As I read through the K3 guide in VJ, I thought there are additional forms to be submitted to NVC??? before it goes to the consulate.

With regards to I-130, once NVC is happy with my submitted forms, when will they send the complete packet to the foreign consulate? Is it after the interview date is scheduled or before? I am trying to plan a trip to be with my spouse but want to make sure my submission is accepted and there’s nothing more they need from me before I leave.

I received approvals (NOA2) for both on the same date from USCISquite confusing since I read from other posts from VJ that K3 is dead.

The K3 remains on the books since the provision in the law that created it has never been repealed. USCIS still approves an I-129F petition filed to start the K3 process (provided it meets criteria for approval). It's a combination of current NVC policy with regard to administrative closure plus the practice of USCIS tying the two petitions together that renders the K3 obsolete.

The approval notice doesnt say that its going to NVC and instead says that its going to the consulatequite confusing.as I thought it goes to NVC.

All I-129F approval notices make no mention of the NVC. However, no file goes directly to a post abroad from USCIS; it always goes to the NVC first.

Would I be correct in concluding that you wish to pursue the CR-1 visa track? If so, then just let the K3 ride to administrative closure on its own and follow all the necessary steps for the CR-1.

July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal
