Hey there

I have a question. I'm from Germany and I'm married to an U.S. citizen since July 2011 and I have my conditional Greencard since June 2012. We met each other in Germany and we were totally in love. He was the love of my life and I was sure he is the one I want to spend the rest of my life and have kids with. We moved to the United States in July 2012 and since then things started to go downhill sad.png He changed so much... He doesn't really care about the things I want to do and we always have to do things the way he wants to... He wants to have kids right away but I started to go to college last fall and told him I don't wanna have kids before I'm done with my education. Besides that I'm not ready to be a mom yet. He is not very happy about that because he says his wife and mother of his kids shouldn't work and stay home to take care of his kids... The last thing I want to be is a stay at home mom that depends on her husband... We are fighting a lot lately and he also told me that I should be careful about what I'm doing because he can send me back to Germany faster than I can think... He apologized for that later and said he wasn't serious but I'm not so sure what to think now. I don't really see any future for our marriage to continue or getting better so yes, I'm thinking about a divorce... I know I can do a removal of conditions by myself after we got divorced but I'm not sure what would be the safer way... To get divorced and do the removal of conditions alone or stay married and get divorced after USCIS approved my removal of conditions?

I would prefer to get divorced right away and do the removal of condition by myself but I don't wanna leave the United States and I'm really scared that they will turn down my application... Do you know about a case where that happened? For what reason could the USCIS do that? I know that I have to proof that I entered the marriage in good faith but besides that, is there another reason why USCIS could turn down my removal of conditions? Does it make a difference if my husband filed for the divorce, we both agreed to file for a divorce or only I filed for the divorce? Would the last case reduce my chance to get the 10 year Greencard? And what's about the interview, do I have to go to one for sure or can it also happen that USCIS accepts all my evidence I submit and approves my removal of conditions? Would you recommend to get a lawyer? If I have to go to an interview, can I take my lawyer with me?


Hope you can give me some answers to my questions. I know I asked a lot but I'm really desperate right now because I don't want to leave the country and go back to Germany... Thanks in advance for your help smile.png

Hello! I have two girlfriends that have got divorce waver prior to ROC, they both received a GC after an interview. One process went really smoothly, another much harder cause ex-husband and his parents dined to help my friend getting her GC (they did not want to write sublease letter), but still she proved her marriage used to be buona.

1) after divorce your husband can not do anything to you (like send you back) Immigration understand that he can avenge you, so they not gonna interview him or ask his opinion

2) Keep as many "split" joint documents as you can NOW! everything is good, even if the papers have only yours or his name, but showing one address.Make copy of his ID. Big advice - make correspondence with him through facebook or mail.

3) You better file the divorce - then you can claim that your marriage did not work because of him, and you did everything.

4) After divorce you will have interview for 10000%

5) Get a lawyer if you dont feel confident. Yes, lawyer will be sitting next to you on the interview.

Dont get stressed this is life - and you entered your marriage in good faith then none in this world cant prove opposite. Good luck and dont be scared!

Nahh .. dont stress ok ? In order to USCIS to simply deny your i751 "just because" its unlikely. USCIS is a very fair governmental department who will look deep in evidences. As I read an article about an attorney saying that nowdays, the law "favorite" the immigrant much more than years ago (well, as you can see the whole immigration bill and amnesty for ilegals) so they will have to find smth HORRIBLE in order to simply send you back home !

Besides, Im sorry to say that, does german ppl even need a visa to come to US ? Sorry but EVERYBODY I have seen that got their i751 approved in like 2 or 3 months (normal its 6 month) are ironicaly from countries who does not need visas to come to US !!

Just get a divorce and file the I-175 yourself. Gathering all the documents you could find since you will need them to prove to immigration that you guys entered the marriage in good faith.

I divorced my ex-husband before the ROC. Filed th I-175 with waiver, no REF, no interview, my greencard got approved in just 5 months.

It could be a stressful procudre but just remember, immigration cares about if your marriage is real, not if it is perfect. You will be fine, good luck.
