I864 - Affadavit of Support - pension/401k allowed?

Hello there, I'm a USC sponsoring my Italian wife to come to the US. I should be getting a job offer but haven't had it offically offered yet. To fill out the affadavit of support i was going to use my assets as a back up. Unfortunately the majority of it is in my 401K in the US and my UK pension. Both of those should add up to the 5xpoverty line, etc. My question is: since I'm 40, can i still count those as part of my assets?

If I add my assets to my wife's, we should have enough. Does her assets count too? Or is all the burden on the USC?

Job offers don't count, so you may want to delay filling in the forms until you actually start work, because only then is your income "current and ongoing".

The 401K counts. As you are currently working, you don;t have the pension yet, presumably? If so, it doesn't count as (potential) future income cannot be counted. But if it is a pension savings account you can cash out, it MAY count (some embassies will not count foreign assets, and I believe the Italian US embassy is pretty strict, but you may ant to search for specific personal ex[periences). Similar with your wife's assets, they may not count if they are abroad but it is worth listing them.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Well, it's a job transfer within the same company so i'm hoping that my employer can write a letter stating the intention to transfer me to the US. Are you positive that funds outside the US do not count?

Ah yes, an intra-company transfer does count.

No, I am not positive- like I said, "some embassies will not count foreign assets"- you are best off doing an Advanced Search (top right of your screen) to search for those with recent experiences with your specific US embassy.
