Hi everyone,

I have a friend that has filed the K1 fiance visa also, she has received her NOA 2 and just found out that her co-sponsor is not going to help sponsor. She said she talked to a family member of hers and they suggested purchasing a bond for the fiance (I guess it some kind of bond, that would be similar to a bail bond), but not sure of how bonds work or what you can purchase them for other than bail bonds. anyways, does anyone know how purchasing a bond works, and if so would immigration accept a bond as assets for the affidavit of support? If not does anyone know what else she can do? I told her to look on here but she said that she could not find anything about what she wanterd to know, thanks, WJR.

Things like stocks and bonds are only supplementary to salary related income. If the sponsor has no steady salary income that is over the set poverty level, then stock and bonds won't help much.

If the bond has a very high monatery value, then you might have an arguement. But, they are really looking for steady salary income as the primary source of support.

I don't have any advice on what else to do, other than try to find another suitible sponsor or have the petitioner try to find a decent job. These rules are in place to keep the fiance from becoming a public charge. If the petitioner doesn't have a steady job and can't find a co-sponsor, then the fiance is of high risk to become a public charge.

wjr,

I don't know how a performance bond for meeting the public charge provision of the law would work, other than that it would not be used as an asset. Might be best to talk to an appropriate person (which would not be a person who answers phones and may not be a person who answers e-mails) at the IV post in question.

heathius,

wjr is asking about posting a performance bond - think of a bail bond - not stocks and bonds purchases by investors.

I think what is being refered to here is on the I-134 it refers to section 5 where it states:

"I am willing and able to receive, maintain and support the person(s) named in item 3. That I am ready and willing to

deposit a bond, if necessary, to guarantee that such person(s) will not become a public charge during his or her stay in the

United States, or to guarantee that the above named person(s) will maintain his or her nonimmigrant status, if admitted temporarily

and will depart prior to the expiration of his or her authorized stay in the United States."

I think this is where the bond confusion is coming in about a bond. Are you asking what the bond actually is? And how much it would cost? And what do they want when refering to a bond?
