I-130 Interview at Local Office - Beneficiary is Overseas

Hello all,

I was wondering if any of you had any experience with our case.

We initiated and submitted paperwork for I130 on November 2012. My spouse is an Australian and she visits L.A. once in awhile on VWP.

I submitted pictures, some joint financial resources, etc, and was worried that they required RFE. However, since I haven't heard anything from USCIS, I contacted my congressman and they contacted USCIS two weeks ago.

Today, I received a letter from USCIS that requested my presence for an interview on May 29. The notice says that I and my beneficiary must appear for the interview.

She happens to be here on VWP -- she came here on March and is supposed to leave on May 28.

The questions are:

1. Do I really need to have her with me?

2. Why are they asking for an interview?

I have read about USC being called up for an interview before the I-130 was approved though I don't recall them having been asked to show up with the beneficiary.

This is just my opinion but I would be doing cartwheels if I were you and I would take my beneficiary with me to the interview but complete with her particulars that shows that she's just here on vacation and her ticket with a date of departure.

Good luck and I am extremely jealous of you folks with VWP options rofl.gif

We will try to have her come with me. As of now, she is scheduled to leave the day before the interview. We've been trying to reschedule for a different departure date, but she's been put on the waiting list. Does anyone else know what to do with this?

I'm not concerned if we can't proof marriage (I do have lots of joint accounts and financial statements), I'm just wondering why did USCIS want my wife present....

Don't reschedule her flight as that will cost you more. Instead take an info pass on USCIS website and get a date this week or next week. Make sure you go with your spouse and take along her passport, return air ticket, and your original May 29 appointment letter from USCIS.

While there, explain to the Officer that, you and your wife didn't want to incure extra charges by reschuling her flight, reason why you had to show up with info pass. I am positive they will attend to you.

05/12/14: AOS (I-864) Accepted – No checklist

05/20/14: Case complete

06/11/14: Interview date assigned (July 29 at 8am)

06/12/14: Case shipped to consulate


CONSULATE (Cameroon):

06/16/14: Case arrives consulate

06/26/14: Case shows READY in system

07/14/14: Medical done - Medical Fees ($220)

07/29/14: Interview date @ 8:00 am. Interview Approved

08/21/14: Visa Received

08/27/14: US Entry

09/05/14: Paid Immigrant Fee via USCIS Elis system ($165)

09/12/14: Immigrant Case received by USCIS Mesquite TX office

10/02/14: Green card received


REMOVAL OF CONDITIONS (I-751):

06/03/16: I-751 sent ($590)

06/06/16: NOA1 Date (I-751 Package received by CIS)

06/13/16: I-1751 NOA1 Hardcopy received (with note EXTENDING CONDITIONAL RESIDENCE FOR 1 MORE YEAR). No need to have passport stamped at local office while case is being processed.
