Hi everyone!

I'm new to this site but I just wanted to say it's such a relief to know that people out there are going through this too and are willing to help and share their experiences!

Im doing all the paper work with out a lawyer so I REALLY appreciate the help. =]

Quick background:

I am the USC and he is from Poland and came here on a touristic visa

I met my him in Paris -Winter 2011

We emailed/skyped back in forth until he came in Summer 2012

He stayed from summer 2012 until winter 2012 (4 months)

Winter 2012 I went to visit him and meet his family (2 months)

March 2013 he came back to the US

We just decided to get married and this is all happening very quickly. The immigrations officer wasnt very nice to him this time when he came in March (he is on a visitor visa) and the date he has to leave is this June (so exactly one month from now!)

We are getting married within the next 2 weeks. Then filing for the adjustment of status based on marriage.

I have lots of questions (sorry) so bare with me please, if you could answer any that would be very nice!

1. Since our marriage will be so new before we send in the AOS I'm concerned about the evidence I will be able to send in. Any ideas? He lives with me- but nothing is really in our names since I'm a student and living at home. We have lots of evidence of our relationship- pictures, plane tickets, etc... but I'm not sure if I need to send that now or wait for the interview?

2. My mom is going to be the sponsor- I'm a student and do a lot of babysitting but dont consider that a job since it doesnt make much at all and I don't file taxes for it. Who needs to fill out the I864 or I864A. I've read both my fiance and I have to do the I864 and my mom would do the I864A? I'm very confused on this!! Sorry

Also- my mom hasn't filed her taxes for this year yet (Crazy I know). Is this a huge issue? :/

3. Is it okay that the check is in someone else's name (my mom's)? Since the money needs to be from a US bank account my fiance will just transfer her the money.

4. Since our marriage will take place so close to sending in this package is it okay that for now our marriage certificate will just be a normal copy- not certified?

5. Both my fiance and I fill out a G-325A each correct? For his it asks residence of last 5 years- I put my address since he is staying with me and then it asks applicants address outside the US and I just put his last address in Poland. Is that okay? Sorry just confused since there are so many spaces for address but only one for "outside the US".

6. Im changing my last name to his after we get married- obviously the only document that I will have with my changed last name will be our marriage certificate. Should I list my new last name under all the paper work unless it specifically asks for my maiden name?

7. Picky question but can I type everything in normal small letters unless it specifically asks for capital letters?

8. He is self employed (software developer)- and works from his computer while here but obviously the business is from Poland. Can I just list him as self employed when it asks for his employer or occupation?

9. Double checking- on the I485 Part 2 we check box a?

Wow! Sorry for so many questions.... and I probably cant promise that I wont have more. Just so you know I do look at the forums here I think I'm just very nervous since its all happening so so quickly and I dont want to make any mistakes... thank you so much for helping.

08/14/2013: AP approved (via electronic notification)

08/17/2013: Received Hard Copy of interview notice

08/20/2013: Received status update e-mail saying combo card is being mailed!

08/22/2013: Received Combo Card in the mail smile.png

09/11/2103: AOS Interview at 10:50am!

09/11/2013: APPROVED!! good.gif

1. The evidence at this stage isn't so important as it is at the interview. Submit whatever you can - I submitted photographs of our relationship together, a joint bank account we opened, affidavits from three friends who knew us as a couple, and a copy of the lease agreement on our house with both our names on it. Make sure you gather as much evidence as you can before the interview.


2. You need to do the I-864, as you will still be the primary sponsor. Your Mom, presuming she is under the same roof as you, will fill out (with you) the I-864A.


3. Yes, that should be fine.


4. We submitted a normal copy with no issues - I believe they are more lenient on this now.


5. That's correct, and what you did seems to be fine.


6. If you are officially changing your name then absolutely list it as such.


7. You can, you can also fill out the PDF via a computer and print it - more legible that way.



8. List whatever is correct.


Hope this helps; I'm relatively new to the process to so I may not be 10000% accurate on the above, but I'm sure another member will correct me if I'm wrong!

Day 28 - May 8th, 2013 - RFE received (I-485) - immediately responded by fax

Day 30 - May 10th, 2013 - EAD approved, card sent to production

Day 35 - May 15th, 2013 - RFE processed for I-485

Day 38 - May 18th, 2013 - EAD card arrives in mail!

Day 41 - May 21st, 2013 - I-485 updated to "Testing and Interview"

Day 51 - May 31st, 2013 - Interview scheduled for July 16th, Dallas

Day 62 - June 11th, 2013 - Started work as a Systems Engineer (IT)!

Day 96 - July 16th, 2013 - Approved at interview in Dallas, Texas! (I-485)

Day 96 - July 16th, 2013 - I-485 updated to "Card/Document production", I-485 updated to "Approved, mailed welcome letter", I-130 updated to "Approved"

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Also, what pages do my husband and I need to copy in our passports?

So far we did the biographical page, his visa, I94, and any pages that were stamped.. is this okay??

I'd appreciate any advice :)

The above is correct except:

2. You fill I-864, mom fills I-864. Mom qualifies on her own as sponsor. Make sure to include her proof of citizenship. And she needs to file taxes before she can be your sponsor.

8. I would not list "self employed;" they want to know his occupation, not how he gets paid. They want to know that he is a software developer.
