Current status updates:

NOA1: Oct. 22

touched: Oct. 25

RFE(touch): Apr. 25

RFE(letter sent): Apr. 30

I just checked the mail this morning and still no RFE letter and this is now day 12. I called them earlier this week and as expected, was told to wait 15 days and there was nothing they could do for me until then. I plan to call them on Tuesday evening (mail arrives before noon at my house) but this is making me very nervous now.

I received my NOA1 within a few days so my guess is that the CSC never mailed it or they mailed it to my lawyer which doesn't make any sense. I did ask them when I had them on the phone and they said it should come to me since the NOA1 came to me. I have also been trying to contact my lawyer to find out if they received it but now I find out that they are in the process of moving or have moved their office from New York to Florida. I tried to call them and found out that one of the numbers has been disconnected and the other a woman answered and told me to Email them. If they do not respond this week (just sent them another Email this morning) then I am going to start the process of filing with small claims court against them to recover all expenses. If I end up having to do this it will be a last resort because they have all of our paperwork and they front loaded our petition so if anything gets lost, we're probably screwed.

So here are my questions:

1. If the lawyer does not respond, how do I get them removed from my petition as my representative if that is even possible. Is there a form for this?

2. Can they (CSC) send the followup RFE letter overnight with a tracking number or just send with tracking information? Is it an option to request this from them?

Also, if any of you are thinking about hiring a lawyer; DON'T!!!

As far as the lawyer goes there is a better option then Small Claims which ALL lawyers hate

Every State has a review board made up of lawyers and you basically file a complaint with them with all relevant documents supporting your claim.

I was cheated by a lawyer in CT and filed a complained and this lawyer eventually had to go to Superior court and resign, he can no longer practice law in CT.

I suggest a different path... for now..

Call into USCIS on monday, ask to speak with an ISO. Sure, you have to play footsies with a CSR, and they'll try really hard with the bullsh|te answers, but be firm yet polite,

and ask for an ISO.

Once you get the ISO, go over the address used for the RFE.

Ask specifically if the RFE postal letter was sent to 123 anywhere lane, catahonga, FL 02332 (or whatever your address is)...

Don't ask them - did you send to my address or the lawyer's address - don't, ever, ask that question.

Then, ask if there are any 'returned mail pieces' on you - and if so, ask them to be remailed to your address at 123 anywhere lane, catahonga, FL 02332 ...

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

Thanks for the tips, I really appreciate both of your responses. Since I can't call them until Monday and Tuesday is the 15th day since they sent my RFE letter, I may just wait for that day to call them. Do you think that is OK to do?

Sorry that you are still waiting, what a bummer. My guess is like yours, that either they didn't mail it when they noticed you that they did, or it went to the lawyer's address. You did say you received the NOA1 so hopefully you also get the RFE. Others who have lawyers should chime in. I have heard of others who have received their RFE hardcopy two weeks later, who knows why it took so long. We all know that the USCIS is not a fair and efficient system. I have heard from a few members who's representatives have been able to get the info on their RFE, I asked mine and got rejected.

If you don't get it by Tuesday, you better make that call, and like the others said, be polite, but firm and persistent. Keep us updated.
