Hi Guys, I have a question to ask which is really bothering me. I am a Nigerian and live in South Africa for 3yrs. I work with a church as an evangelist. I have been waiting for my permit for voluntary work which was taking for ever to be processed as the home affairs in charge of issuing permits was unnecessary slow not only in my case but numerous others. The only thing that kept you legal was the receipt from home affairs that your permit is under processing. Earlier this year my fiancée told me she will be coming to Nigeria that we should meet and file for the k1 but without a permit going back to SA will be impossible. Someone told me I can travel by showing the receipts from home affairs so I went ahead and made the trip on getting to the airport I was fined for over stay in SA. I am in Nigeria now and will be getting a new visa to go back to SA but my question is will this affect my chances of approval? Since Lagos easily play the red flag alert. In the i354 form I was asked to start address of where u have been and worked for the past 5yrs should put Nigeria and South Africa? I plan to pay the fine because I still need to go get a police certificate that I have been there for 3 yrs. I was advised to erased SA from the process but our chat logs have cases of me being in SA. I want to be as honest as I can as I always believe in the truth. Is my over stay in South Africa going to be an issue? Plz I need advice on how to go about this and I will appreciate as many responses as possible cos I will be sending the i345 biometric form to my fiancée by Tuesday. Thanks guys.

Your over stay or deportation from any country outside the United States has no bearing to the chance of you securing a visa to the United states paradventure it is not on the ground of criminality. US has a lot at the back of their hands than to be all bothered up with your other activities. However, honesty is the best policy. There is no point in lying and I will suggest to you that you should always seek a legal advice from the appropriate authority rather than getting help from unreliable source, the situation that got you to a point where you are currently at. Speak the truth always and it will set you free. Your activities in SA is a worthy course so I dont see any reason for you to wipe that off your traveling history. Please there is no point in lying. Keep it real and it will all work out for your good. A little lie may cause you a life time regret. God bless you.

Your SA residency and overstay issues will have no negative effect on your K1.
Lying about your stay in SA has the result of a lifetime ban to come to the USA for misrepresentation.
List ALL addresses.
Believe me, they will know where you have been if they put you in AP. Yes, you do need a police certificate from SA .
You can't hide a 3 year stay in SA from Lagos !

Don't listen to all the "experts" around you that are ill advising you to lie. Do the right thing. As an Evangelist you already know what to do and that is do not lie.

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Nigierians are famous for the "tricks" they suggest to ensure a visa. Most of those tricks will put you in a position that will keep you from ever getting a visa. The US wants honest people to increase it's population and you need to deal with them honestly at all times. They don't care that you travelled there and overstayed, they do care that you didn't engage in certain crimes.. As for police certificates you need them for any place you have lived more than six months since you became 18 not just for the last 5 years. Many police certificates can be ordered without returning to various countries so you may not have to return.

This will not be over quickly. You will not enjoy this.

Thank you guys. I am so relieved. Romnik,Gowon,NigeriaoBurst and Ebun may the good Lord be with you guys. I will not compromise my salvation for a tiny white lie never but still I am very relieved after reading from you guys. I will still visit SA cos I have a few things to clear there with my pastor so I will pay the fine and get it over with. I don't have any criminal record there or Nigeria. Talking about getting police certificate do I need to get one from Benin city and Lagos as well as I have stayed in these places including Ibadan or will the one from Lagos cover Benin and Ibadan? I will appreciate response to this effect. Thank you guys and God bless you all. You guys rock.

For Nigeria, you need just one police report and that would cover anay state youhave lived in. It used to be that you mjusttravel to lagos to get it at Alagbon Police headquarters but now I hear your state police office can initiate the porcess and forward to Alagbon for final approval.

For Nigeria, you need just one police report and that would cover anay state youhave lived in. It used to be that you mjusttravel to lagos to get it at Alagbon Police headquarters but now I hear your state police office can initiate the porcess and forward to Alagbon for final approval.

Yes, just go to your nearest State Police Command, in Ibadan it's Iyaganku.

That being said it is much cheaper at Alagbon in case you're in Lagos for other reason.
