Hello Everyone,

I just got off the phone with USCIS and I am very confused, maybe someone can help me.

I called in august to inquire about my case and I was told that it was in Missouri. I asked when was it transferred because the letter I got came from Kansas. So after awhile of being on hold, the agent told me that it was in Kansas, then in Missouri, and now back to Kansas. I thought this was weird but I just let it go. So now I call back today and the agent on the phone tells me that my case is in Missouri. So I asked her the same question, when was it transferred, and she does not see that information, but tells me that I should have gotten a letter, which I never received. She then told me that right now applications are taking 1 year, and they are processing October 2012. I asked to be transferred to a tier 2. The tier 2 officer was the rudest person I have ever dealt with. She told me that my case was in Lincoln, Nebraska. I asked why have I been given different responses regarding the location of my case and she told me she does not know, and sarcastically said I should call the two agents I spoke to and ask them myself. Then I told her I did not get a letter regarding my case being in Lincoln, Nebraska. And she said she did not know why and if I was done, do I have any more questions, all the while talking very rude to me. I told her please calm down and be polite and she got even more upset and told me, since you have no other questions have a good day and I told her wait and she did not care and said by Mrs. XXXX and hanged up on me. I called back again and spoke to another agent, who apparently could not give me the information of where is my case, but told me to report the incident with the Tier 2 and gave me the information of where to report it. So now I am very confused, I do not know where is my case. I do not know if these people were lying about the location and just assumed all the applications go to the same place. Or if my case has been transferred around and I did not get notified. What should I do? I know I am going to call back again tomorrow, but in reality they are not helpful at all. Please can someone help me. thank you.

wow that is horrible. you may have better luck with a congressional inquiry

We've also made a few enquiries and have consistently been told that they're current processing Oct 2012.

But if that's the case, why did they make the statement to the AILA meeting in April that there was no backlog? And why are March filers getting prroved before October filers?

Didn't you receive email from USCIS regarding your request? If so, what did they email to you?

The letter I received regarding my request simply stated they received my request and they will give me a response shortly. This was back in August. that's what prompted me to contact my congressperson because Shortly became whenever they felt like responding but like Lonelywithouthim stated, They put in their request August also and they didn't get approved until October so go figure. Just never know..regardless stay on USCIS. Good Luck

Lisa called USCIS yesterday and was told they are currently processing Sept 2012 applications.

I am waiting in New Zealand to join my wife (married 23 years), so I called the US Consulate here in Auckland. They are very friendly, but are unable to do anything until the file moves from NBC to NVC. They said once that happens and I pay the next lot of fees, they can try to get the file sent to Auckland to at least expedite the next phase.

They did also say the following:

I meant to tell you too, that we just heard that NVC has received four times the usual number of approved petitions this month, and that Posts abroad should expect increases in cases being sent out – apparently USCIS have worked hard on their backlog! So hopefully your case will be among that number. "

My wife filed for I-130 and here is the description below.

May 20, 2013- USCIS: Your Case Was Received.

September 20, 2013- Case Status : Initial Review.

3 weeks ago it was transferred to Nebraska Service Center.

Nov 1, 2013 when i checked my case on USCIS website then it was on Post Decision Activity but she have not got any email or letter about it.

# What does Post Decision Activity means?"
I don't have a Yahoo account, but maybe someone here does and could ask him about more details?

Hi guys,

I am sure some of you have seen uscis new website... They have the processing time estimates for the national benefits center on there now. It says that for a spousal I-130, it should take 11 months to process... That means that The estimates of September 2012 being processed now are probably correct. I don't think ours will be processed until April next year....

This is still the same update they put out last month as it still says "updated Aug 2013." The updates usually comes out around mid month, so hopefully, we will get an updated chart soon that will show decreased time....

We received an answer to our service request today. It said that due to work load issues not related to our case, we should expect an estimated 6 months delay in the process from the date of the notice. Wonderful.

IR1 took 520 days....

Can you word this differently? Do you mean add six months to the 11 months posted? Or does it mean six months from NOA1 to NOA2? Or something else?

I'm pretty sure it's six months from the day Ellinora received the response, which is six months from today. I think it's a bunch of #######, to be perfectly honest. Work load issues my rear end. They don't have workload issues! Because if they really really had workload issues, they wouldn't be processing I-129Fs for K-1s in 2-3 months. Am I not making complete sense here people???? What a crock...

I am not normally one to come to the aid of USCIS, but in their defense, there are ten I-130's submitted for every K-1. Even if USCIS devoted their entire K-1 resources to I-130's it would only put a mere dimple in the backlog. If we are only talking spousal I-130's, we just don't have any figures.

Are you saying the current backlog is justified?

I am not sure how you could draw this conclusion from my statement. The backlog is a complete failure of management at USCIS, either as a result of negligence or incompetence. The transfers seem to be an attempt to do something about it, but the results are so far inconclusive. Today for example, we have no approvals to show for on this site, which translates to not much activity at USCIS for I-130's.

If you look at the stats, they have indeed received more I-130's than usual, but not to the scale that would guess by the backlog. The problem is that at the time when submission rate rose modestly, adjudication rate dropped. And it stayed that way for months on end. Clearly, someone in management knew this was happening. It's inexcusable.

My main point was that using K-1 resources will not solve our problem. USCIS would need to pool resources from many departments to fix this, which the transfers appear to be an attempt at.
