Our congressman replied yesterday that he has put forward an official inquiry on why our case was sent to a place that was not even open and why they have exceeded the 60 day timeline, which they themselves have announced. We'll see if this inquiry amounts to anything, one can always hope...

Hi Ellinora, I am a little confused... why is your timeline 60 days? Isnt the standard timeline for CR1 about 180 days?

I inquired twice for my case... both times I was told the processing times have increased to 9-12 months

The posted times are only estimates... you can file a complaint with the ombudsman.

"What is the processing time expected to be for stand-alone I-130s filed by an overseas petitioner?

Response: The current processing time for stand-alone I-130s filed by an overseas petitioner is
approximately 60 days from the date of receipt at NBC"
The document is dated May 10, 2013 so just when we filed.
As for LoveMyTico's comment, no we don't expect miracles to happen, but we are also not comfortable just sitting here doing nothing, not saying there's anything wrong with just waiting, just not our style. Ombudsman is next at 6 months, although I doubt that makes any difference either. Contacting a congress(wo)man and ombudsman office are really our only options of doing something, so we make do with what we have. If anyone else has any better ideas, would love to hear them.

IR1 took 520 days....

I wasn't trying to be nasty.... Nobody is worse at waiting than me. I will contact my senators office every month from now on.. and I will try and find other ways to get more info.... It might not do an damn thing.. but its better than sitting here doing nothing.

you have to realize that no matter what is posted about the processing times, they are only estimates. They don't hold themselves to it, and they don't let anyone hold them to it either. The goal for processing at the USCIS is 5 months. but the average is 9.5 months. goes to show that they don't care. If there were some kind of competition out there where you could pick your own adjudicating agency, then they would be processing their littles asses off. But since its the only place we can send our papers, they get to make the calls.

Yes, I realize they are estimates. And eventhough they are just estimates, taking more than twice the estimated time is something to inquire about. And if no one inquires about anything, nothing will change. But hey, that's just my opinion, everyone is entitled to their own of course.

What is a tier 2? N how do i do that? How do i find out when or if my case was touched?

Tier 2 are the immigration officers. They are the people that are suppose to be able to give more detailed information about your case. Notice I said "suppose to be able". Sometimes they can be rude when you speak to them, so be calm. I guess they power trip lol. Anyway, When you call USCIS (1800-375-5283) push the commands as if you are having issues with your case ( always work for me). When the person answers, let them know that you need detailed information about your case. Once they transfer you, there may be a wait. You can choose to stay on hold or have them call you back. I always choose for them to call me back and they do. Once you receive the call back from tier 2 then you can ask all the question you want. Remember they can be rude at times but sometimes you can luck up and get a nice one. Good Luck!!

Fine, they can take as long as they want/need with the I-130s, but then why is the K3 route dead? I'm not the US citizen, but I'd be mighty pissed about my constitutional rights being infringed upon by this administrative blackhole that's keeping me separated from my legal spouse indefinitely.
