Initial Review

On March 27, 2014, your date of birth was updated relating to your I130, IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN. Please check our website at www.uscis.gov for further updates on your case. Please wait until the end of normal processing time before calling customer service at 1-800-375-5283 for live assistance.

During this step, USCIS initiates the background checks of the applicant/petitioner and identifies issues that may need to be addressed either during an interview or by asking the applicant/petitioner to submit additional information or documentation. USCIS reviews the applicant's/petitioner's criminal history, determines if there are national security concerns that need to be addressed, and reviews the application/petition for fraud indicators.

If you have not already contacted your senator, please do so; it helped me; they put inquiry for me on Friday, and I was approved on Monday.

I was also transferred to NSC on 12/12/13 - total time from NOA-1 to NOA-2: 8.5 months.

Oh, since the beneficiary is "male" from a Muslim nation - this could be the reason of this lengthy background check. There is another person on VJ, male beneficiary from Pakistan - took 12 months for NOA-2.

How did you finally find out they sent it to the wrong place? Did USCIS finally tell you that? Is it now in the right place? I hope so!

Looks like you applied almost to the day we did...

The Department of Immigration in Oklahoma called to set up an interview with me and realized it should never have gone to them. I don't live in Oklahoma, also it is a stand alone I-130. When I called USCIS they insisted it wasn't in the wrong place even after I told them someone called me. The Senator's office confirmed that it was incorrectly sent to Oklahoma. They are suppose to be actively working on it. However, when I called today they said I had to wait 60 days from the last transfer. The last transfer in February to the incorrect place in Oklahoma. That means your file has been touched by officer, but who knows what are they doing on your file. Like mine, the officer took my file in Dec 2013, but until now I just got the update above. All the times I contacted to them, even my Senator contacted to them. The responses are "case pending for background check clearance". So "your file has been accessed" or " your file has been assigned to the officer" are mean nothing to me.

Thanks for your reply, I appreciate it, although it doesn't sound like good news!! I can't believe it took them three whole months to process your application once it was "accessed", I'm just so freaking out now...I decided on the spot to send in the appeal to my Senator officially requesting her help in finding out what is going on...I've been on the phone with them but they have an official process...so hopefully something will come of that, and someone else mentioned that we should do that too!

I feel horrible that you've had to go through with this, and for the mistake, what a nightmare. Hopefully it will take much less than 60 days...i think that's what I'm worried about that someone told me in another post, once they "access" your file, it still takes months for them to process it!

I'm a little confused though, does the petitioner also have to do an interview? I thought my wife, in Taiwan, would have to go in for the interview, she's not the petitioner though, I am...

Anyway, just curious, and again sorry to hear this, hang in there and stay positive, I keep telling myself it's just a matter of time!!!

No, you are exactly right. Just the applicant has the interview. Thank you so much for your kind words! I keep telling myself the same thing - that approval is coming soon...for both of us.
