Our application is at the National Benefits Center in Overland Park Kansas, too. Our immigration attorney said they typical wait time for approval on an I-130 Visa is approximately 2-4 months.

We, however, submitted an Expedite Request. Hopefully, it will be sooner. We are supposed to hear something back from them within the next week!!!

So exciteddddd, can't wait for my honey to come "home" to the USA.

We filed on the 21st from Australia.. 73 days and counting! We are deciding if we will still be able to get there before the end of the year! Hurry up NBC! Good luck everyone!

How often does your petitioner call USCIS? Do you call every week or more/less often? What do you say/ask when you call?

Husband has now called USCIS twice, so about once a month. He just asks what's the situation and where our case is. He's never been transferred to anyone so I'm assuming he is just talking to a person who has the access to the same info we get from USCIS website, am I right?

What have you guys said in order to be transferred to tier 2?

IR1 took 520 days....

I tell them that I need to speak to tier 2 because I need detailed info about my case and I know they are unable to see it.....it always works. :)

Our petition was received on May 9. Nothing yet. USC is abroad, so it's supposed to be quicker?

We also filed a K3 just-in-case, even though it's supposed to be obsolete...... but with this slowdown whaddya think, is there a chance our K3 will actually be processed??

I'm exactly in the same boat. Except my spouse is in the US now, and her visitor visa is about to end soon, and we are contemplating on one of the following options:

  1. an extension on her visitor visa, I-539 form.
  2. do the K3 route, I-129F form.
  3. have her go back to her home country and re-enter the US with her multiple entry visitor visa for another 6 months?

Not sure which of the 3 options would be best for my spouse. sad.png

Hi,

I'm new to this forum. My husband and I have been living in Europe for 18 years, of which the last 15 yrs married and we have 2 kids. As we are moving to Boston this fall, we filed the I-130 early May and received the I-797 from Overland Park, KS on May 10. We used a foreign address. Since then it has been silent but yesterday we heard that our file would be transferred to a local field office (and they guessed it would be Vermont) and that the processing time is approx. 12 months.

I read that some of you are hoping that your file would stay with the NBC as the processing times are less. Do you know what influences the file being transferred to a local field office? is there anything we can do here?

Also, if we file a K3 as well, would that eventually be sent to the same field office as well?

Hi,

Unless you request an expedite, there is no way your whole family will be able to move to the USA in the fall of this year. They are now saying that processing time to petition approval is 12 months, but it still seems like it's "only" about 6-7 months (depending on the local field office). As far as we know, petitions filed from abroad usually stay at the NBC which has meant in the past being processed in 3-4 months. But, as always, it's a crapshoot. You can call USCIS 5 times and get 5 different answers from different people. You *may* be transferred, you may stay at the NBC. You might get approved in 3 months, 6 months or 12. I would plan for moving the family in at least a year, if not 1.5 years. Best wishes.

We filed our I-130's on May 22, 2013. My wife's went to the California Service Center (CSC) and my son's was sent to the National Benefits Center (NBC). My wife's was petition (I-130) approved on July 23, 2013. Did a service request to, through a tier 2 officer on July 26, 2013 asking that my son's petition be expedited to bring his in synch with my wife's. Tier 2 officer said to check back on August 10 on status.of the expedite request (which the tier 2 said shouldn't be a problem) so keeping my fingers crossed.

Wow! You're the first of the May filers to get approved then! Congratulations! A lot of us are still waiting for approval. My wife and I received NOA1 on May 15, 2013. Still waiting for NOA2.
