We have not filed the EAD form yet, but would like to get her a SSN. Will they give us a problem obtaining the SSN?

You're a K-1er. If you select either of those two boxes, then you have selected the wrong box. You should select the box which says: "Legal Alien Allowed To Work."

After entry on a K-1 visa, you have from about 2 weeks after arrival until about 2 weeks before the I-94 expires to get a SSC. This is one of those hit and miss items which depends on how well trained the SSA person is. As a K-1 visa holder you are a "Legal Alien allowed to work" which allows you to apply for and receive a SSC. THe card will have the restriction "NOT VALID FOR WORK WITHOUT DHS AUTHORIZATION" which is the EAD or GC. So you can apply for and recieve a SSC, but cannot legally work until you receive the EAD or GC. This is all spelled out on the I-9 form which employers are to complete for all new hires.

If you do have problems geting a SSN and are within teh I-94 time frame, you might want to take down the name of the person you dealt with, the time and date, and the local SSA office you visited and send an e-mail off to the main SSA website to get their assistance in training their employee.

Try talking to the field manager or the supervisor if ever you will encounter problems regarding the SSN number, The first time we went to the SSA the guy told me that i have to wait for my EAD so i can apply for SSN when i posted here Tahoma told me that i should go back because i am allowed to file for SSN as i am under K1 so i did and when we went back for the second time the field manager was the one who entertained us because the other staff isnt aware of what to do and we got done with it in no time. In the SS card you will see a print that you are only valid to work with DHS authorization or something like that. Hope this helps. God bless :)

Thanks everyone. We will have to go back because her new "married name" did not match the name in the system. Once the AOS is entered into the system I assume her name will be updated.

^^^ Your marriage certificate is the document that bridges the gap between her maiden name and her married name.

Chinook and I had no problem. Chinook received her Social Security card in her maiden name a few weeks after she arrived in the U.S. and before we were married. Right after we were married, and a month before her I-94 expired, Chinook used our marriage certificate to update the name on her Social Security card to her married name. No problem.

This was her first attempt to get a SSN. The person at the office told us that the name on her application would not match what was in the system at USCIS because she had her maiden name when she entered the system. That makes sense, and I did not think about that until that moment. No problem though. I have read many that say they don't get SSN until after marriage so they won't have to go back for name change. The only current issue I have is I cannot add her to my AD&D insurance at work yet because they want a SSN so they can be assured to charge taxes on any benefits she may receive. tongue.png

My employer had a work around for not having a SSN when I added my new wife to all my benefits. Fortunately, it only took a couple of weeks to get the SSN. I am sure you can add her and if she gets benefits before she receives a SSNohmy.png then the government will have them keep 25% to cover taxes.

The clerk is wrong. No surprise there. Lots of K-1ers get their first SS card after they are married and before their I-94 expires.

Easiest to apply in VISA name. I pray you two did that.

When we receive the NOA letter for our AOS and EAD filing will the case have her new married name?

It will have the name you put on the application. If you put her married name then that is what will be on the GC. If you used her maiden name then that is what will be on the GC. You can change it at ROC or at Naturaliation if it is not correct. Do not pay the $390 for the I-90 to have the name changed if it is not the right one now.

if you two used her 'married name' then there is NO SAVE record whatsoever.

Is faster and easier to apply in the VISA name - go back, ask the clerk to do a SAVE DB lookup in the VISA name, instead.

If the clerk seems confused, ask for the supervisor - and make certain she applies in the VISA NAME.

There is no issue with the SAVE system: her marriage certificate will bridge the gap between her maiden name and her married name. Lots of K-1ers have done this.

disagree, in toto.

Why ? with no SAVE 'hit', the entire thing gets sent out to USCIS for verification.

Since the AOS hasn't been filed (for most folk) within the 90 day window, then there is no record with USCIS.

Time passes, Tempus Fugit, and 6 weeks later the DHS report comes back 'no record found' using that name.

by that time? window to apply for SSN is over.

What you've described becomed the 'bane of one's existence' when the window to apply passes, the issue is the SAVE lookup attempting married name when USCIS has no record of it.

It's a huge issue - I'm almost scandalized you'd say 'is no issue with the SAVE system'
