Hey Guys,

Currently I am working in a company and my IR-1/CR-1 Visa is under process.

I have recently submitted DS 230 Documents to NVC.

I was wondering when should I resign from my current Job as I am not going to stay here.

One of my friend who is also processing his IR-1/CR-1 Visa said he is going to resign once his case goes to NVC (looking at his company's 3 months of notice period)

I was thinking of resigning once I get the interview date, what do you suggest?

I just don't wanna wait to serve notice period in my company after getting visa (my company also does have 3 months of notice period but hopefully can negotiate to 1 month)

Are you sure you want to resign before you have your visa in hand?

As stated in the previous post most persons have 2 months before the date of the interview by the time they get notice of the interview date. In addition you usually have 6 months to leave after you get your visa.

Petitioner LPR upgraded to USC June 22, 2012
August 22, 2012: case complete
October 18, 2012: Interview (APPROVED)
October 26, 2012: Picked up visa from DHL (delay caused by Sandy)
December 15, 2012: POE Atlanta....................became USC July 2016!!!!

Mothers' Journey (My sister is the petitioner)

September 10, 2013: Sent I-130 (UPS next day service)

September 12, 2013: Received text to confirm delivery

September 16, 2013: Received NOA 1

March 22, 2014: Received NOA 2

April 8, 2014: File Received by NVC

May 26, 2015: Interview (approved)..........now LPR (delays caused by 2 RFE)

Also you don't know if you're going to be put into AP or not. It might be best to wait on the visa. Granted I quit my job but I'm from Canada and female. It would be extraordinarily rare for me to be put into AP.

edit:

Some countries it is 6 months from the visa date that you have to move and in some countries (like Canada) it is 6 months from the MEDICAL. I would double check which it is for you!

You should resign with it is more convenient and feasible. There is no right answer to your question, for you know of your particular circumstance...

If you need to work in order to be able to keep yourself, it would behoove you to wait until your visa is issued and you have it on hand before handing in your notice.

What does it hurt to quit , with only 24 hours notice, after you have your passport back with the visa stamp inside and an air ticket in your hand?

I'd weigh that, before anything else, really.

Thanks Guys. I am not sure my company will allow 24 hours of notice period, as official is 3 months.

You all are right.

I also did enquire about it more and found the exact answer from a legal guy, posting it here so that all can get what he said to me.

He said "You definitely not want to resign from your current job unhook you get the visit in hand. Keeping every simple reason aside, for them (Visa Guys) you don't wanna look like you will become Public Charge after going there, makes sense?"

So, in short, as you all said, Do Not Resign Now :)

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Why? You write it down on your resume and it's highly unlikely a US company is going to call India. Unless you've been an exceptional employee with many awards I'm just saying your Indian work experience may or may not be helpful in the USA. Education doesn't really transfer over either. To be honest I think it's one of the biggest culture shocks for people. They're highly educated and have great jobs in their home country; then they come to the USA and have no education or experience because that's how the USA often rolls with foreign education and work experience. It is not always that way, it depends on the industry and accreditation but it's a good thing to be prepared for.

- NOA-1 received: 08/10/2012

- STUPID RFE ( G-325A) :-/ : 01/25/2013

- RFE sent: 02/03/2013

- NOA-2 Approval: 02/14/2013 (On Valentines day ;-) Lol)

**NVC process**

- Received date: 02/25/2013

- Case # generated: 03/08/2013

- AOS fee bill & DS-3032 inst: 03/16/2013

- AOS fee paid & DS-3032 Email sent: 03/19/2013

- IV fee bill invoiced: 04/02/2013

- IV fee paid: 04/03/2013

- IV package sent: 04/08/2013

- IV package delivered: 04/11/2013

- AOS package sent: 04/16/2013

- AOS package delivered: 04/19/2013 (Quite late though :-/)

- Checklist rcvd: 04/25/2013 (PCC + AOS Package(false one) )

- PCC Obtained: 04/29/2013 (Not submitted to NVC)

- Case completed: 04/30/2013

- Interview date rcvd: 05/01/2013

- Case forwarded to Mumbai Consulate, India: 05/04/2013
