Hi everyone,

I'm just new here at the forum and i need your help. I have a 11yrs old son in the philippines that i want to bring in the U.S but i dont know where to start.I got here in the U.S when my mom petition me in 2002 as an F-24 VISA (single) and got my U.S citizenship in 2007. i am 26yrs old when i left at the philippines and left my son when he was 3 months old but never been married to my girlfriend that time. i have my own family now in the U.S but i still want to bring my son here. I have a couple of question to ask if anyone knew or have experience in petitioning family member(s).

1) whats the form to use in petitioning my son?

2) what kind of documents do i have to submit to USCIS?

3) what is BONAFIDE? because I never been back to my country (philippines) ever since i got here in the U.S how can I prove or what kind of evidence should i submit?

4)i have my son Birth certificate and it show on that certificate that there is a date or event of marriage,( i remember the midwife tell me that we need to create a date so that my son will have my last name). what should i do to correct this?

i really appreciate if you can help me with my problem and thank you so much.

2) what kind of documents do i have to submit to USCIS? A copy of your Naturalization Certificate or US Passport. Your son's NSO Birth Certificate.

3) what is BONAFIDE? because I never been back to my country (philippines) ever since i got here in the U.S how can I prove or what kind of evidence should i submit? You have to show proof that a parent-child relationship exists between you and your son. Pictures, greeting cards, money remittance slips (financial support).

4)i have my son Birth certificate and it show on that certificate that there is a date or event of marriage,( i remember the midwife tell me that we need to create a date so that my son will have my last name). what should i do to correct this? Putting a false date of marriage is wrong. Your son's mother should have that corrected at the Local Civil Registry where your son's birth is recorded.

There is a possibility (during the embassy interview) that the consul will demand a DNA test.

yes, i dont have any pictures of me and my boy and i lost all my remittance reciept, and we only using facebook as our communication. am i going to have some problem on that birth certificate because of that marriage date? cause i know i have the same issue with my boy when my mom petition me, i have a marriage date on my Birth certificate too. is there anyway that i can use some sort of NOTARY or AFFIDAVIT to prove that there is no marriage happen on that date?

The boy's mother can have it corrected here in the Philippines, both of you will need to submit a CENOMAR (Certificate of No Marriage) as proof that no marriage happened during the time of your son's birth. You will need to execute an affidavit too, have it notarized at the Philippine Consulate who has jurisdiction over your state then mail it to your son's mother. Once she has it, she will need to have it authenticated at DFA. On the other hand, she will need to execute an affidavit of her own.

Bring the affidavits and CENOMAR to the Local Civil Registry. She will be advised there on what to do. You need to fix this first before you start the i-130 process.
