Hello

As some of you may know, I am making my way through the AOS paperwork for H1-B -> CR-1. My wife is a USC, I am an H1-B visa holder.

For form I-485:

Question 3B asks us to "List [our] present spouse and all of [our] children."

I understand that I should list my wife and check "no" under "applying with you." I have a question about her children.

My USC wife has a USC daughter. I am her step-father through marriage. Do I list the child in this section? (Obviously I consider her my daughter but I am trying to go by the letter of the law). If I list her I am assuming I will also check "no" in the field mentioned above.

I will be working through a similar process soon (from L-1B), so I don't have the answer to your question. However, I will point out that you are not "adjusting to CR-1", you are adjusting status to become a permanent resident. CR-1 is a visa for entering the country as a spouse of a USC, and you don't need that as you're already in the US with a work visa. If you're filling in forms for CR-1, you should stop.

Yes, I am not familiar with what will or will not be stamped in my passport and when. Thanks for pointing that out. Perhaps I'll start another thread about it.

I suppose I should have said AOS from H1-B Specialty Worker to LPR.

As for the question above, I think I will consult the attorney(s) at work.
