I'm gathering up the various documents I'll need to send in with my N-400 in a couple months (filing on 5 year rule since I'm divorced). I know I need to include the divorce decree with the paperwork, but I'm wondering if I should also include the complaint/petition of divorce as well. I notice that some people are asked for it and end up getting an RFE for theirs.

What do you think? Is it important for me to send it or should I just get my hands on a copy and bring it along to the interview in case the officer would like to see it?

I just want to be prepared!

I only included the divorce decree, but took everything else to the interview. The IO didn't ask for anything.

Wife's I-130:

03/15/2019 NOA1 (Nebraska Service Center)

02/11/2020 Case transferred to Vermont Service Center

02/02/2021 NOA2 الحمد لله

02/04/2021 Approval email
02/12/2022 NVC documents submitted

Ok. Thank you for your input. Will do.

I'm going to bring everything I have too in case it comes up. Thanks for your reply.

You only need to include what you're asked for...which is the decree.

Who are these people that received RFEs for their complaint/petition?

Ok. Thanks.

I've seen it be a concern for people when date of separation is an issue as it relates to removing conditions.

Our relationship soured abruptly almost a year after we got approved for removal of conditions and we were divorced two months after that (we lived in a no fault state, with no required separation period and had no kids so it was all quite fast). Our date of separation was 6 days before the actual divorce petition was filed and is listed as such in the document. I don't really think this situation is similar to those I read, but you can never be too certain.

Agree with only sending in what the N-400 asks for, N-400, copy of green card, two passport type photos, and most important, that check.

But would bring all that documentation in with your at your interview since you were divorced. Have no idea what kind of IO you will get and may save you an extra trip with more delays.

You also need to send in what the M-477 checklist asks for, which includes divorce decrees if you've ever been married. It doesn't ask for divorce petitions though.

I'm also filing under 5-year rule (divorced 19 months after my I-751 was approved) and have both: copy of the divorce decree and divorce certificate. Couple of questions:

1) which one should I attach with my N-400?

2) do I need the original of divorce decree to take with me to the interview (as of now I have only copy of it)?

3) I just realized that my divorce decree has a typo as to the date of our marriage - would that cause any problems - if so how can I fix it?

Any help will be greatly appreciated!
