So you are filing for a K-1? And you filed prior to the marriage being anulled...in other words you filed prior to being free to marry? And did you list the marriage on the petition? And how did you provide proof of a divorce?

good.gif This. When you submit the I-129f petition for fiancee, AT THAT TIME you have to be legally divorced and free to marry. You cannot have the divorce finalized AFTER you send the petition. If your divorce was not final, you will receive an immediate denial on your petition. It does not matter if your divorce is final now, what matters is that it was final when you submitted your paperwork. Unfortunately any money you sent in is lost as well. In this case you would have to refile a new petition, with a new payment.

If your divorce in fact WAS final, and you submitted proof of that, then you are OK. If the proof you submitted isn't good enough or they want something more specific, they will send you an RFE and ask for it.

Ohh yeah sorry forgot to mention but we did apply after my marriage been void or annulled ,we've waited 1 year and 5 months before we've got the final decree..and we also include the copy of that on our packet..i can also get a copy of my marriage contract in NSO noted that it was declared void fr.the beggining,,so i am free to marry..

just wonder if i still need to send a copy of my void marriage contract to the immigration,or no need?

thanks again..:)
