I130 Still Waiting Approval... Stuck. :(

I filed my i130 for my spouse in January, 2013 via Chicago Lockbox. She is a Canadian Citizen and I'm a USC. She lives in Canada (and is there currently). I received my NOA-1 very quickly but since then nothing. I called USCIS and spoke to a tier2 on several occasions. Finally, in early march I was told my case was sent to my local field office in NYC. I had some shimmering hope... Then a month later, the case went cold again. The last time I called the tier2.. A week ago.. They seemed to have gotten irritated.

Anyhow my question is, I know it'####### or miss on approval processes, but how much longer can this take? Should I take a lawyer to help push this further? I heard local offices take much longer. Is there any other forms I can file in the interim to keep the case going? I know I can't do the i485 because she's not living here....

Any help would be GREATLY appreciated.

This is my second time filing.... the first time back in 2008, it took 8 months to get my NOA2 at the Vermont Service Center. It was a very painful wait. But the good thing was, once it was approved, it was sent to Costa Rica within a week and I was able to call the embassy and get all the info I needed. We had an interview within a month of the approval. Good Luck !

thanks for all the support guys -- that link definitely helped me organize myself and im in the process of gathering the relevant documents.

i actually have two additional questions as i read through this --

  1. We have kept my wife's maiden name throughout the documents we filed because she never changed her last name in Canada. Is the DS230/260 or keep everything the same for consistency?
  2. Im a joint sponsor for my dad on his brothers application. do i have to list that and does it negate me from using the I864EZ?

I'm a September 2012 filer yet to receive approval sad.png

Hi Nabby1 -- did you try calling USCIS and asking for a tier2 rep?

Hi Nabby1 -- did you try calling USCIS and asking for a tier2 rep?

we call uscis every week , had an info pass and also applied for e request all they say is that the documents are correct and my file is still being processed and they can't say how much more time it may take .. When my hubby had info pass in April they said they'll be sending the approval in a weeks time n now after e request they say they cant estimate how much time it might take ... It's really depressing :(
