I filed my i130 for my spouse in January, 2013 via Chicago Lockbox. She is a Canadian Citizen and I'm a USC. She lives in Canada (and is there currently). I received my NOA-1 very quickly but since then nothing. I called USCIS and spoke to a tier2 on several occasions. Finally, in early march I was told my case was sent to my local field office in NYC. I had some shimmering hope... Then a month later, the case went cold again. The last time I called the tier2.. A week ago.. They seemed to have gotten irritated.

Anyhow my question is, I know it'####### or miss on approval processes, but how much longer can this take? Should I take a lawyer to help push this further? I heard local offices take much longer. Is there any other forms I can file in the interim to keep the case going? I know I can't do the i485 because she's not living here....

Any help would be GREATLY appreciated.

Currently it is 6 to 8months waiting time. You're only 4 or so months into the process so be patient.

No. A lawyer cannot speed it up for you. S/he will end up taking your money and you will end up having to wait.

You answered your question on the I-485.

Today is exactly 6months for me and still patiently waiting.

Make an infopass at the local office where your file is located. Nobody on the phone can help you with any information you don't already have.

Processing times are different from office to office.. 8 months is a really long time .. should be in the 5 month range.. mine was 2.5 months

Thanks folks, I read somewhere that if you file the I-485 it might help because it will trigger them to look at the 130... But I'm skeptical on that.

Who woulda thought USC+Canadian Citizen would take forever!

What type of questions should be asked at the infopass appt?

One thing I've learned browsing here on VJ and other websites is that there really is no pattern to USCIS. I mean, I've seen a case of a Brazilian couple in a similar situation to mine here on VJ. They applied in September for the CR1 visa, and still haven't gotten an approval. Whereas, My husband and I applied in late October, and got an approval Feb 2nd. So really, go figure.

hi, i filled i 130 for my husband back in november 2012 and i havent gotten anything other than my recite number. everytime i call one of the reps tells me to wait some more. they tell me a different average processing time everytime it talk to them. should i worry? anyone know what month they are working on now? what is left if they approve my case?

Being from Canada has nothing to do with it. Just because they are closer does not mean they go any quicker! wink.png

But seriously, 5-8 months is normal. Unfortunately this is the time for patience. We have all been there.. or are there. It sucks now, but will be so worth it in the end!

Great news guys! the i130 was recently approved!! :)

Since shes not here, and living abroad -- im assuming the next steps are they will contact her now? i got the NOA2 but it was simply a notice saying it was approved and to wait for further action. Is there anything we need to do on this front to organize any documents?

Since shes not here, and living abroad -- im assuming the next steps are they will contact her now? i got the NOA2 but it was simply a notice saying it was approved and to wait for further action. Is there anything we need to do on this front to organize any documents?

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

definitely keep an eye on the process at this time.. approvals recently have gone down a black hole and have taken up to two months to reach the nvc
