Okay, here's more questions i have:

1- My husband is a salesman, he has a salary plus makes commision on top of his sales, when i enter his wage in the support affidavit what sould i put? His hourly wage only, or an average of his final income?

2- I want to send a letter from my husband's employer, what does the letter need to say? (he only gets the checks and not pay stubs...)

3 - Can i apply for the travel document now with my AOS? My father (well, step father) is in critical condition in the hospital and i really really want to be there for my mom...

4- If i can apply, how does the travel document work and how long does it usually take to receive the approval?

Put the dollar amount that was gross income on last year's tax return.
2- I want to send a letter from my husband's employer, what does the letter need to say? (he only gets the checks and not pay stubs...)
Consider using the I-864EZ, it requires only past 3 years tax returns, transcripts are acceptable, and free from the IRS.

http://www.irs.gov/faqs/faq1-6.html

I-864EZ

For employer letter look at the guides:

Basically, your employer letter should state "To whom it may concern: (first name, last name) has been employed

full-time with the XYZ Company since 200_ as a (name of your job), and is an employee in good standing with an

annual salary of $XXXX. Signed, John Doe, Supervisor (or whatever title)" The letter should be on company

letterhead.

Yes you may see if you can file for emergency AP at your Field Office, do an Info-pass appointment and bring I-131 filled out and proof of emergency such as a letter from a doctor. http://infopass.uscis.gov/
4- If i can apply, how does the travel document work and how long does it usually take to receive the approval?
Up to 3 months

Thank you Dan :)

Put the dollar amount that was gross income on last year's tax return.

On the EZ form, on question #18 it asks the sponsor for his/her current income...

So lets say his salary is $10 hourly, but added the commision this average goes to $25...should i enter which average as the income?

julieubie,

1. Form I-864? Which question, specifically? There are several that ask for income information and they ask for different things.

2. Check the Guides and Visa FAQ for a 'laundry list' of what such a letter might include. In your husband's case it would be good if the pay policy of salary+commission is explained including how commission is determined. As a practical matter the letter will contain only as much as the employer is willing to state. There has to be way that he can get current pay statement information from his HR or payroll department if it's not provided with his checks.

3. Yes

4. Form I-131, advance parole option. See the Immigration Timelines
