Hello,

I'm from England and I'm planning on visiting my boyfriend in New York State for 5 months as of July. By then I will have just finished with my schooling, so will no longer be in education, and I am also unemployed, other than voluntary work on a Saturday. I have 100% intention of returning by Christmas at the latest, but how can I prove this in my interview?

My boyfriend wrote a letter for me to present at my interview confirming the invitation, and he and both parents signed it to certify they will take full responsibility for my stay there. I also wrote on my DS-160 form that my dad would be paying for the trip, so if I take a bank statement of his will that be sufficient? I don't have a bank account so he would send any funds to my boyfriends account, which he has done before so should I take evidence if this too?

I'm nervous about it so any help would be greatly appreciated!

Why are you not eligible for the VWP?

OP mentioned she was hoping to stay for 5 months. You can only use the VWP for visiting up to 90 days.

To the OP: I don't know the first thing about applying for a tourist visa. Hopefully someone can shed some light concerns. Good luck!

If she is eligible for the VWP applying for a B2 would be a very bad idea.

Why are you not eligible for the VWP?

As caly said, I intend to stay longer than the 90 month allowance.

I just recently learnt that if my tourist visa is refused, I won't be able to travel on the visa waiver program either. Is it close to certain that an ESTA would be refused because of this? Or just a possibility?

I can say that I have read of many denials of tourist visas from the UK. It seemed they got little discussion and they were just told they didn't provide sufficient documentation of ties to the UK, wouldn't look at anything brought to the interview, no discussion--denied. Maybe it's because the UK is a VWP country, so you better have a really good reason why you need a visa. And maybe only the complainers told their stories and others are easily approved.

If you are denied the visa, then you are no longer eligible to use VWP. Maybe a 90 day visit is better than risking no visit??

If you are denied the visa, then you are no longer eligible to use VWP. Maybe a 90 day visit is better than risking no visit??

I'm beginning to think the same, I would rather have a definite 90 day visit than an unlikely 150 day visit. It's not a gamble I want to take!

Not so.

You would need to update ESTA and it seems that you are likely to be denied for 6 months or more.

Not so.

You would need to update ESTA and it seems that you are likely to be denied for 6 months or more.

Right. Thanks. But that would mess up her plan for this summer. I didn't explain that very well.

Well, since you've already filed the papers, you may as well go through with the whole endeavor as cancelling the process will have the same effect as a denied visa. If your visa is denied, it won't necessarily keep you from using the VWP, but you would need to submit a new ESTA application with the updated info. The problem you will face is that the very fact that you seem to be able to uproot your life for 5 months with minimal consequences plus having a boyfriend in the US will be seen by the interviewer as evidence that your ties to home aren't particularly strong.

Have you already submitted your visa application? If not, don't and just apply for ESTA and stay for less time.

I had an interview booked for May 10th, hence my urgency! But I hadn't filled in an ESTA form, so just cancelled the interview. I think that means my ESTA will remain uneffected, considering there was no refusal.
