hi everybody on visa journey

i have a question from you guys i have a friend her husband had interview in afghanistan , but first on the interview he said they are not first cousins and they took his passport and after some investigation they found they they are first couisins and now the embassy returned his passport but did not give him the visa yet what is your sugestion for him he is so depressed now , will he get the visa or his fiancee should get a lawyer ,i know the state his fiance lives allowed first cousins marriage i dont know why they lied .

Well, he wouldn't have been denied for it, but the lie implies other lies so they can expect a long wait.

I would assume they will be denied for suspicion of fake relationship and have to do a spousal visa instead.

I also assume he will be denied as well due to the lie. Lie once to immigration and they have no reason to believe another word.
If this winds up to be the case, and the fact they handed him back his passport shows they are in no hurry to approve - she may want to lawyer up.

He lied to Immigration under oath, I doubt he will be getting a visa anytime soon.

04/2006 - Interview (1st time) denied

Waited, waited...... no review

06/2009 - Filed k1 (2nd time)

09/2009 - NOA 2 approved

12/2009 - Interview (2nd time) APPROVED! VISA ISSUED

02/2010 - Arrived USA

04/2010 - Married

AOS Timeline

4/19/2010-Sent to Chicago Lockbox

4/26/2010-Received texts and emails 7th day

4/30/2010-Received NOA's(Hardcopies) 11th day

5/3/2010-Received ASC appointment notice(mailed 4/29/2010)14th day

5/7/2010-Walk-in Biometrics done(2 weeks earlier)18th day

5/13/2010-Case transferred to CSC

6/2/2010- Case received/resumed at CSC

6/18,6/22,6/23 AOS touches

6/28/2010- EAD production and touch on AP

6/29/2010-AOS APPROVED

7/2/2010- 2nd update on EAD production and touched on AP....

7/6/2010- Received "Welcome Letter" and AP document

7/12/2010-Received GREEN CARD and EAD

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

When was his interview second did he check his case number status it's showing under AP or what ....

i dont know about his AP but they asked him second time for interview and the consulate said speak the truth cause we know the truth about you and your fiancee now and he spoke the truth now he said we are cousins we did not say it before cause we thought it will make problems, and the embassy gave his passport and his documents back after holding it for more than 3 months

you can not lie to the CO or if you was not sure should say Im not sure because once they fund out is not true ...they wont believe anything so get advice from a lawyer plz ASP..Allah with you...there always a solution when you pray Allah...

yes on form he said no they are not related.cause he was afraid according to US law he cant marry his cousin, and now the embassy found out they are cousins

If he was not trying to hide the fact that they are cousins, then he should not have lied. They gave him his passport back and his paperwork, then he is denied.

Actually there are 19 states that allow it, with another 6 under certain circumstances. The big question here though, is the OP said it was legal in their state - so why lie??
This will be a tough one to overcome... as mentyioned many times, once proven to lie immigration has no reason to believe anything else. Seems like a weird thing to lie about if it was in fact a legal state.
