Hey there...

here goes another question.

I had my medical done in November of 2005 for my K1 visa....I applied for AOS and EAD in August of 2006...and that is still in progress...so, since the medical is only valid for 1 year, will I get another RFE from CSC stating I have to get another medical done?

I just don't understand when the medical time period expires...Obvisouly, if you file your AOS 1 year after the medical, you'll need another one, but what happens if the medical expires within your processing time?

The date of the application is the benchmark. Your medical was valid when you made your application so you should be good to go.

It does not matter when you get your interview as long as your medical was done within the 12 months before you filed for AOS.... so yes you are good to go... no new medical needed...

addendum:

Theoretically it's good, but I would be very surprised if you don't receive an RFE for a new medical if it was done that close to a year ago, especially if you're sending your application through CSC. They seem to take the date of your medical as the benchmark not the date of your application. For instance, my son had his medical in March 2005 and we sent his application for AOS in Jan 2006. His medical was technically still valid but we were RFE'd for a new one.

I questioned this and was told that each Service center has the authority to ask for anything it wants to and the one-year medical "rule" is only a guideline. If they want another one they can ask for it and if you don't send it you'll be denied.

I wouldn't go and get another one just now but be awarem that especially at CSC the one year is only a guide and being so close to that you may get an RFE.

Just wanted you to be prepared in case - as it does happen!!

I mean, it wouldnt surprise me if I got an RFE for that...so I am prepared.
