JFK temporary work permit

Timeline

Hi everyone, my fiancee is going to arrive with a K1 visa through JFK airport, and I understand that she might be able to obtain a 90-day temporary work permit at that POE. My question is: If she does get the temporary work stamp, does she also need to get her Social Security card before she can begin to work? Or can she start working right away with the temporary work stamp (without getting the SS card)? Thanks

she will need a SSN to give to her employer.... so she will need to apply for one once she is here.... some people say to wait a week to allow her information to show up in the SAVE system others say to wait 2 weeks... but it can take up to 4 weeks or more...

Well technically she can begin work without an SSN as long as she has work authorization and has at least applied for the SSN. Finding an employer that will go along with that might be a bit difficult.

The other thing to keep in mind is that work stamp is only good for the 90 days the K-1 status is valid.

So the chances of finding an employer that will hire her to work for 90 days and without an SSN or slim and none.

Mdyoung, just one thing in regards to the last thing you wrote. You mentioned that the temporary work stamp is only valid 90 days. But do most people get their official EAD card before those 90 days are up, so that way they can just continue to work in the job they are already at? I guess it depends on when you apply for the EAD, but I was just curious if most people get this BEFORE the 90 days are up. Also, when you say that she can work as long as she applied for a SS number. Does the SS office provide her with a receipt, saying that she applied? Thanks again.

Yes the SSA office can provide an SSN application acknowedgement notice when she applies or a receipt if the SSN will be assigned.

-- requests an acknowledgement of his/her SS-5; and

-- has submitted documents with the SS-5 that need to be verified with the issuing agency

Form SSA-5030 (Receipt for Application for a Social Security Card) is to be issued to applicants who are allowed to work only with authorization from DHS. The card will have the legend “VALID FOR WORK WITH DHS AUTHORIZATION”.

A receipt form confirms not only that the individual applied for an SSN card but also that a card will be issued. Therefore, be certain that all requirements to obtain a card are met and a card will be issued before providing a receipt.

I got the stamp at JFK, and went to some temp agencies the week I arrived to get everything rolling. I showed them the receipt I got from the Social Security place and they said 'oh... right'. They basically didn't do anything for me until I went back and showed them my actual SSN.

As for EAD overlapping the temp EAD, who knows, probably not, but I sent of my petition11 days after arriving, so you never know! Oh and that SAVE stuff doesn't actually seem to be an issue... But someone can correct me if I'm wrong. I went to get my card a week after arriving and they didn't say anything about it.

Basically if you have a Job line up for your fiance, she can start working right after she apply for the SSN even without the card, she will get a receipt from the SSN office to show that's it's pending and can tell the employer she will bring it once received. The problem without the SSN the employer may not be able to create the Check, as the Social security tax and bunch of other bureaucracy. It's Doable but Good luck and hope your fiance have a safe flight

True but tis the seasaon. Holiday help in shop, its easy to get and tthey only want you for a short period anyway.
