Every state has its own rules and regulations regarding a drivers liscence, the best thing you can do is check with the DMV in the state that you will reside in, if either of you happen to live in NY (which is where I live) I can tell you that procedure

Aside from green card, you can use either one of these:

1. passport, visa and I-94 -> license will expire on the date stamped on I-94

2. EAD card --> license will expire on the date on the card

You don't need the GC. I got my DL after marrying and applying for AOS. They asked for my AOS application receipt + passport + i-94 + SSN + proof of residence + out-of-country driver's license and its certified translation. Check with your DMV/BMV as the requirements change from State to State.

OP, it is best to check your state's requirements on the DMV website.

For CA, you'll need at least 60 days prior to I-94 expiration and passport. If I-94 didn't meet the requirement, then EAD and AP combo card or GC should do it.

Yeah, I know. I had researched the Oklahoma DMV website before and saw it, and thus tried to apply. At the DMV they however told me that K1's are not eligible and that they do not accept my valid I-94, and that I have to come back with a Green Card. I had the same issue in Oklahoma. I also had to wait for my EAD. Once I had my EAD it was no problem (although the name on my EAD had to match the name on the social security database, so first I had to get my name updated with SSA).

However it was perfectly legal for me to drive using my foreign license in Oklahoma until I was able to get a state DV. Insurance is another issue though.
