This is a query to see if any one has been sucessful in expediting their I-130s for an IR1/CR1, and for what reasons?

I mentioned to an Immigration Officer at the USCIS on April 12 that my mother was diagnosed with “stage IV adenocarcinoma non-small cell lung cancer metastatic to the brain” and that I would like my wife to meet her before she passes away. He kindly said he would request to expedite the process under a motive of "humanitarian situation" with the National Benefits Center. As I did not receive any further notice for several weeks, I called back last week and was told to fax a copy of the I-130 receipt, a cover letter explaining the situation and proof of medical condition. The package was faxed Friday. Monday morning I received a note stating:

"The status of this service request is:
Due to the high volume of expedite requests for this case type, we are strictly enforcing the criteria that has been set for these expedite requests. While your situation appears serious, you have not provided evidence of an extreme emergent need."

Apparently a decision was made without regards to my support request and documentation (the timing had to be concidental).

My question is this...what can I do next, if anything? Is this an insufficient reason for a request to expedite, given the requirement of "an extreme emergent need"? Will the NBC still read the contents of my written request versus the contents of the verbal request made several weeks ago?

Any thoughts are welcome.

Sorry to hear about your mother. Ive never delt with this issue. Here is what is on the state departments website

Im not sure how they will classify you, but if it was me I would call and see if I could speak with someone at least. Its worth a shot anyway. Good luck to you, best wishes for your family.

Thankyou for sharing your thoughts! The whole process is just so unbelievably byzantine and inhuman. I am sure I will be re-united with my wife at one point, it is just sad to think that she will not be able to meet my mother and vice-versa. My wife is Russian and my mother the child of Russian emigres. There was some gesture of continuity here for myself and my family, however the USCIS apparentely has their own definition of a "humanitarian situation". Unfortunately one that is more quantitative than qualitative.

A follow up to the original post I made about the I-130 expedite. I received two rejection notices from the USCIS from my own attempts, however I made a simultaneous request via my Congressman and it was approved. Apparently US representatives have a completely separate track from US citizens when trying to expedite. My advice: do not give up and do not assume the system works. It is highly flawed, though there are some very intelligent and compassionate people at the USCIS. You just may need some extra help in getting to them.
