ok so random thinking maybe if i get him to agree probably not he is stubborn as a mule. but if we gets on the marriage Visa and let say we get married while he is here, does he HAVE TO go for all that green card stuff or can he go finish school in Aus can we get married and finish school then worry about the whole green card thing or are they expecting once we get married to do that. and if we do get married and wait would it affect his whole comming back here after he finishes school because he didnt apply for the green card?

i dont want to ruin his chances but i am trying to think how i can help bring him here. and also on the K1 how immportant is it that you have to met TWICE before?? i mean it says unless family cuiture. well i am american he is indian.... his family doesnt fully approve over us, but we are getting there. sorry for all the questions but its been 23 months today i want to see my baby i miss him so much.

I think you need to reread the guides to get a better handle of all of this. You can get married whenever you want. You don't need a special visa for it. The K-1 and CR1 are meant for people that are staying in the US permanently. If you are not to the point that you will be staying permanently then you can come in, get married and go on your married way. You can file the spousal visa later when you are going to return to the US permanently.

As for the K-1 you need to have met ONCE in the past two years. At least.

I think you need to reread the guides to get a better handle of all of this. You can get married whenever you want. You don't need a special visa for it. The K-1 and CR1 are meant for people that are staying in the US permanently. If you are not to the point that you will be staying permanently then you can come in, get married and go on your married way. You can file the spousal visa later when you are going to return to the US permanently.

As for the K-1 you need to have met ONCE in the past two years. At least.

If he is concerned with his schooling in Australia, have him enter the US on a VWP, get married and fly back to Australia, however, I would caution you not to have him say anything to this effect at his Port of Entry or he may be denied entry (people are able to adjust from a VWP and this would be seen as intent to stay).

When you are ready for him to permanently move to the US, apply for the CR-1 visa (Spousal visa).

Seeing your boyfriend is a citizen of India, you should probably change your country to reflect that, otherwise you will receive the wrong information from people.

And he cant use the wavier because he is not a Au citizen or resident.

he would have to show that to get the wavier unless there is a way he can but honestly i looked into that but if there is a way he can still use it, being a student on a student visa in aus. then please share details.

This is a site for immigrating TO the US, in order for people to give you proper advice, you need to supply us with the correct info, changing the country from Aus to India would be a start. I'm from the US, but my wife is from Canada, which is why I have the Canadian flag.

Your boyfriend is not eligible for the VWP as India is not a VWP country. He will have to apply for a B2 tourist visa.

first of all..

K1 is to bring FIANCE into USA to get Married.. (once married in USA, then you AOS, BUT they can not leave USA until they get green card)

CR1 is to bring your SPOUSE into the USA.. (they have green card waiting for them at POE)

you need decide the first!!

sounds like he needs to finish school first!, from what you are saying
