hi everyone,

I have one question regarding the filling of i-131.

I am a J1 visa holder (will expire ni June): I am filling AOS with i-130, i-485, i-765 etc...

If I get the advance parole and I decide to travel after my J1 has expired BUT while my i-485 is pending, may I be refused entry to the US when I come back ?

I would have liked visiting my parents in July, but if that's an issue, I'll just wait until I'm approved.

Thank you for your answers.

Well, let's say i travel in july, my AOS is pending, my VISA J1 has expired in June 2013. I know I am not illegally present in the US because I have a pending i-485, but I know rules can change when you travel, that's why i am asking.

However, if you're filing now, there's no guarantee your advance parole will be approved by July. It typically takes 90 days.

Spouse-based AOS from out-of-status H-1B, May - Aug 2012

Removal of conditions, Aug - Nov 2014
