Marriage in USA or Mexico

Hello everyone,

I have a few questions...

My partner and I want to get married. I am a US citizen and he is Mexican. We have known each other for a long time. Last year in July, I had moved to Mexico and about 2 weeks ago I came back to the USA because I am expecting a baby. I was planning to move back to Mexico after having the baby, but I now believe it is better if I stay here. My partner is still in school.

What happens if he applies for a student visa and he comes here and we get married?

Is it better to get married in Mexico?

If I get married in Mexico, can I stay there until he comes with me (I had a job in Mexico)?

Should I stay here and work here??

I'm confused on what to do ....

Well first you need to figure out where you wanna stay. I was under age, when i was mexico. So there wasnt a way i could go back to the usn i got marry in mexico. Had my baby as well over there. I have to do the CRBA process to make her like a born us citizen because im the Us citizen. That was 3 years ago. Im in the Us since 1 year and a half. And filed the I 130 for husband to get him as a green card resident.in the looong wait now

Ohh. Forgot to mention, if you do get marry in mex. They will acknowledge it as well in the US. Just gotta get the marriage certificate translated(offically) they charged me $50 in arizona. Just make sure you check into the state that you are in mex for requirements, i know for sure they will asj for your birth certificate translate if its in english. Luckily my parents made me of 2 nationalities. So ob my mexican birth certificate, it does show im from the US, ARIZONA, PHOENIX as country of both. And you will need to show your passport

if he can get a student visa that would be easier and then just get married here and apply for a adjust of status since he would have come in legally it won't take long..PLUS he will be here with you and baby.

Hi Ximena, it sounds like you guys have a few options and need to decide what is best for you... but just to let you know that if you want to come back to Mexico, get married, and apply for his visa from here, you can do that through Direct Consular Filing (DCF) as long as you are a resident here in Mexico (not just on a tourist visa - but you have dual citizenship, right?). The DCF process is very quick if you have all the supporting documents. Some people have received their visas in less than two months. If you follow that route, you might need a joint sponsor (since you won't have a US income) and you will need to show that you have maintained or intend to re-establish domicile in the US. It's not too difficult and there's a lot of great info on this site for help along the way... and people who have gone through the process too... smile.png

August 2008 - met when we were both living in England

February 2009 - began dating

May 28, 2011 - got engaged

August 5, 2011 - got married (in England)

September 29, 2011 - moved to Mexico

VISA PROCESS:

December 3, 2012 - sent I-130 to Mexico City (DCF)

December 6, 2012 - I-130 approved

December 14, 2012 - NVC case number assigned and instruction letter sent from Juarez Consulate but we NEVER received it

March 4, 2013 - called to check about our case and received our NVC case number and Invoice number

March 9, 2013 - submitted DS-260 online

April 17, 2013 - interview date - visa approved!!!

July 11, 2013 - POE: entered US through Dallas, TX

July 22, 2013 - Social Security Card delivered

August 22, 2013 - Green Card delivered

Yes, I have dual citizenship. Thank you... This was very helpful ... I think I might go this route

The DCF process would be the best way if you both plan on living in the US for a minimum of 3 years. Your husband will receive a greencard and since he is married to you, he will be eligible to take the citizenship test once he has been in the US for 3 years.
